HomeMy WebLinkAboutMINUTES - 11281989 - 1.13 1- (3 THE BOARD OF SUPERVISORS OF CONTRA COSTA COUNTY, CALIFORNIA Adopted this Order on November 28, 1989 by the following vote: AYES: Supervisors Powers , Fanden, Schroder, McPeak & Torlakson NOES: None ABSENT: None ABSTAIN: None SUBJECT: Completion of Warranty Period and Release of Cash Deposit under the "Clipper Drive" Bridge and "Harbor Point" (Now Called "Newport Drive") Bridge Road Improvement Agreement for Subdivision 6760, Byron Area. On June 7 , 1988, this Board resolved that the improvements for "Clipper Drive" Bridge and "Harbor Point" (Now Called "Newport Drive") Bridge were completed in accordance with Drainage Permit 433-87 with deficiencies, for which a $5,000 refundable cash bond was presented; and This Board further resolved that a Road Improvement Agreement to guarantee the one year warranty period was APPROVED. s The Board hereby FINDS that the deficiencies have been corrected and the improvements have satisfactorily met the guaranteed performance standards for one year after completion and acceptance; and IT IS BY THE BOARD ORDERED that the Public Works Director is AUTHORIZED to refund the $5, 000 deficiency cash deposit and the $2,800 performance cash deposit (both under Auditor's Deposit Permit No. 139975, dated May 9, 1988) plus interest in accordance with Government Code Section 53079, if appropriate, to New Discovery, Inc. , pursuant to the Road Improvement Agreement and Ordinance Code Section 94-4.406. I hereby certify that this is a true and correct copy of an action taken and entered on the minutes of the Board of Supervisors' on the date shown.
