MICHAEL WALFORD, CHIEF ENGINEER DATE: November 14, 1989 SUBJECT: APPROVE RIGHT OF WAY CONTRACT FROM ANTHONY DIGENOVA FOR THE UPPER PINE CREEK PROJECT IN THE CONCORD AREA Project No. : 7520-6B8688 Task: ACQ Account: 3540 SPECIFIC REQUEST(S) OR RECOMMENDATION(S) & BACKGROUND AND JUSTIFICATION I. Recommended Action: A. APPROVE and ACCEPT Right of Way Contract dated October 26, 1989 from Anthony DiGenova which provides for a payment of $900 for improvements taken during construc- tion. B. AUTHORIZE Chief Engineer to execute said Right of Way Contract on behalf of the District. C. APPROVE payment of $900 as compensation for said improvements and AUTHORIZE the Auditor-Controller to issue a check in said amount payable to Anthony DiGenova, to be forwarded to the Real Property Division for delivery. II. Financial Impact: Payment of $900 from Flood Control Zone 3B funds which are 75% reimbursable from State Department of Water Resources. III. Reasons for Recommendations and Background: To reimburse property owner for improvements removed in connection with project construction. IV. Consequences of Negative Action: Failure to compensate could result in litigation.
