HomeMy WebLinkAboutMINUTES - 11141989 - 1.48 1-049 THE BOARD OF SUPERVISORS OF CONTRA COSTA COUNTY, CALIFORNIA Adopted this Order on November 14, 1989, by the following vote: AYES: Supervisors Powers , Fanden , McPeak, Schroder , Torlakson NOES: None ABSENT: None ABSTAIN: None RESOLUTION NO. 89/ 733 SUBJECT: Provision for Landfill ) Capacity at Specified ) Disposal Costs for ) Alameda County. ) The Board of Supervisors of Contra Costa County RESOLVES that: Alameda County Resolution No. Z-6767 allows for the import of municipal solid waste from Contra Costa County under certain terms and conditions including reciprocal rights for disposal of Alameda County as follows: "Reciprocal capacity shall be provided by Contra Costa County at a price not to exceed the disposal cost at Altamont Landfill as inflated by Exhibit B provisions or resulting from mandated costs attributed to changes in federal or state regulations. This capacity shall be guaranteed in whatever landfill is finally approved and developed in Contra Costa County. This capacity shall be guaranteed to the Alameda County Waste Management Authority and its member agencies upon reasonable notice of its need and without conditions." (Resolution Z-6767, Page 4) . Exhibit B is an inflator/deflator index. The Board of Supervisors wishes to assure the Alameda County Waste Management Authority and its member agencies of its intention to fully comply with the provisions of Resolution Z-6767. Therefore, the Board hereby reaffirms the commitment presently contained in the 1989 revision to the Contra Costa County Solid Waste Management Plan to provide reciprocal landfill capacity at any landfill within the unincorporated areas of Contra Costa County under regulation by the Board of Supervisors upon reasonable notice of need by the Alameda County Waste Management Authority and its member agencies. Such capacity shall be provided without conditions excepting those which relate to public health and safety. Further, the Board hereby agrees to provide reciprocal landfill capacity at its regulated landfill at the rate paid by the municipal solid waste ratepayers within Contra Costa County for Altamont Landfill disposal capacity under Resolution Z-6767, as adjusted by Attachment A provisions or resulting from mandated costs attributed to changes in federal or state regulations. 1 hereby certify that this is a true and correct copy of an action taken and entered on the minutes of the Board of Supervisors on the date shown. Dept: Community Development Director cc: County Administrator County Counsel Alameda County Waste Management Authority (via CDD) Oakland Scavenger (via CDD) Acme Transfer Station (via CDD) RESOLUTION N0, 89/733 ATTACHMENT A ANNUAL ADJUSTMENT INDEX FOR RECIPROCAL LANDFILL CAPACITY RIGHTS OF ALAMEDA COUNTY Reciprocal landfill capacity for Alameda County shall be provided at a cost not to exceed the cost paid at Altamont landfill, including mitigation fees, annually adjusted according to the following formula: (B) + (D) P = A x (C) (E) 2 A equals the per ton rate paid by Contra Costa County for landfill capacity at Altamont Landfill, including mitigation fees. B equals the Adjusted Hourly Earnings Index Total Private Non-Agricultural (in current dollars) published by the Department of Labor, Bureau of Labor Statistics, in effect on the day that the adjustment takes place. C equals the Adjusted Hourly Earnings Index Total Private Non-Agricultural (in current dollars) published by the Department of Labor, Bureau of Labor Statistics, in effect on the date of first export to Alameda County. D equals the Gross National Product Implicit Price Deflator for Producer's Durable Equipment (Nonresidential) published quarterly by the Department of Commerce, Bureau of Economic Analysis, in effect on the day that the adjustment takes place. E equals the Gross National Product Implicit Price Deflator for Producer's Durable Equipment (Nonresidential) published by the Department of Commerce, Bureau of Economic Analysis, on the date of first export to Alameda County. P equals the adjusted base rate per ton for the succeeding twelve (12) month period. Should the formula standards or publications become unavailable in the present form and on the same basis as the last standards published immediately prior to the execution of this Agreement, the Contra Costa County and the Alameda County Solid Waste Authority shall agree to a replacement standard. The purpose of such replacement shall be to produce as nearly as possible the same result as would have been achieved using the standards in their present form. The Department of Labor may not issue the appropriate "Adjusted Hourly Earnings Total Private Non-agricultural (in current dollars)" on the first day of each quarter; similarly, the Department of Commerce may not issue the "Gross National Product Implicit Price Deflator For Producer's Durable Equipment, {Non-residential)" on the first day of each month. Any adjustment shall nonetheless be effective one year after the date of first export to Alameda County and annually on the anniversary of that date. H5/pro-land.br
