Spooner , Contracts Administrat Costa DATE: November 1, 1989 County Approval for Renewal of Two Routine Drug Abuse Program Novation SUBJECT: Contracts for Fiscal Year 1989-90 and Fiscal Year 1990-91 SPECIFIC REQUEST(S) OR RECOMMENDATION(S) & BACKGROUND AND JUSTIFICATION I . RECOMMENDED ACTION : Approve and authorize the Health Services Director or his designee , ( Stuart McCullough) to execute on behalf. of the County , two standard form Novation Contracts , upon approval of each contract document by the County Administrator , or his designee , for the continued provision of the same expanded drug abuse prevention , intervention , and treatment program services for a two-year period from July 1 , 1989 through June 30 , 1991 , as follows : SIX-MONTH TOTAL EXTENSION FY 89-90 FY 90-91 PAYMENT PAYMENT CONTRACT PAYMENT PAYMENT LIMIT LIMIT -NUMBER - - CONTRACTOR -LIMIT - LIMIT 7/89-6/91 7/91=12/91 24-472-2 R.E .A. These contracts include a standard provision for a six-month automatic contract extension from June 30 , 1991 through December 31 , 1991 . These Novation Contracts are for a two-year term in accordance with the policy of the Board of Supervisors established' June 27 , 1989 for Contracts with Nonprofit Agencies . II . FINANCIAL IMPACT : These contracts are funded in the Health Services Department Budget for Fiscal Year 1989-90 and are financed by the same Federal Block Grant Funds . The two fiscal year payment limits set forth above do not include any cost-of-living increases for Fiscal Year 1989-90 or Fiscal Year 1990-91 . NOV 14 1989 CCI Health Services (Contracts) ATTESTED Risk Management Phil Batchelor,Clerk of the Board of Auditor—Controller Supervisors and County Administrator Contractor M392/7-e8 BY ��, DEPUTY Drug Abuse Program Novation Contracts Fiscal Year 1989-90 and 1990-91 Board Order Page 2 In the event that the Board of Supervisors authorizes a cost-of- living adjustment expressly for these contracts before December 31 , the fiscal year payment limits and total contract payment limit for each contract may be modified by a written Administrative Amendment executed by each contractor and the County Administrator , or his designee, to reflect any such cost- of-living increase , except that this provision shall not be construed to require agreement to any such increase . Furthermore , the contract documents include a provision which terminates each contract without notice for the 1990-91 fiscal year if the federal funding for each contract ceases and which makes each contract valid and enforceable only if sufficient funds are made available by the State Budget Act for Fiscal Year 1990-91 for the purposes of each contract program. III . REASONS FOR RECOMMENDATIONS/BACKGROUND : These contractors have been operating these same contract programs for the County continuously since FY 1987-88 , and they continue to provide these expanded drug abuse prevention, inter- vention , and treatment services for youth , minority populations , and the homeless in the Antioch and Pittsburg areas of the County . These program services continue to be a vital and important part of the County ' s continuum of care for County residents with drug abuse problems , including support for their families . These contractors have been providing these program services under an automatic extension of the FY 1988-89 contracts . The recommended Novation Contracts replace the six-month automatic extension under the prior contracts .
