SUBJECT: RESOLUTION ESTABLISHING "DRUG FREE ZONES" IN THE SCHOOLS OF THE
UNINCORPORATED AREA
SPECIFIC REQUEST(S) OR RECOMMENDATION(S) & BACKGROUND AND JUSTIFICATION
RECOMMENDED ACTION:
(1) Direct the County Administrator's Office, County
Counsel and the Sheriff'.s Department to prepare a county resolution
establishing "Drug Free Zones" within 1000 feet of school grounds in
the unincorporated area of the county similar to the resolution
adopted by the City of Pittsburg (attached) .
All possible ways to make this as strong an action as
possible should be pursued.
( 2 ) Refer the issue of signing such zones to the CAO to
coordinate between school districts and the Sheriff's Department.
BACKGROUND INFORMATION: Federal law allows for much stiffer
penalties in the drug-free school zones .

BEFORE THE CITY COUNCIL OF THE CITY OF PITTSBURG
In the Matter of:
Resolution 89-7501
A Resolution of the City of Council
of the City of Pittsburg Establishing
"Drug Free Zones" Within 1000 Feet
of Pittsburg Public Schools
WHEREAS, the drug epidemic is rapidly growing in the City of Pittsburg, the
East Bay, and throughout the nation; and
WHEREAS, the sales of drugs to children is particularly deplorable in that it
is illegal, destroys young lives, has disastrous effects on families and
communities, and ultimately the future of our nation; and
WHEREAS, the United States Code, Sections 845 and 845 (a) of Title 21, provide
for enhanced penalties for persons who distribute drugs to individuals under
the age of 21 or who distribute drugs within 1,000 feet of schools; and
WHEREAS, the City of Pittsburg may request, through the U. S. Attorney
General's Office, federal prosecution of violators of Sections 845 and 845 (a)
of the United States Code.
NOW, THEREFORE, BE 1T RESOLVED, that the City Council of the City of Pittsburg
hereby approves of establishing "Drug Free Zones" within 1,000 feet of public
and private elementary and secondary schools; and
BE IT FURTHER RESOLVED, that by copy of this resolution, the U. S. Attorney
General's Office will be advised of the City of Pittsburg's participation in
the war against drugs and encourage federal prosecution to the maximum extent
possible for all drug offenders violating the City of Pittsburg's "Drug Free
Zones;" and
BE IT FURTHER RESOLVED, that a copy of this resolution be forwarded to the
Contra Costa County District Attorney's Office.
PASSED AND ADOPTED, at a regular meeting duly held thereof, on the 18th day of
September, 1989, by the following vote:
AYES: Members Canciamilla, Davis, and Mayor Parent.
NAYS: None.
ABSENT: Members Currie, Lettman.
ABSTAINED: None.
