RECOMMENDATION
1. Accept report trom Community Development Department
Director, transmitting the recommendation from the Hazardous
Materials Commission regarding response to a State
Department of Health Services letter, dated October 6, 1989,
suggesting a new policy direction from the State for
"Pair-share" proposals in county hazardous waste management
plans.
2. Authorize Chair to send proposed response to the State
Department of Health Services.

REASONS FOR RECOMMENDATION/BACKGROUND
Our County received a letter from Mr. Kenneth Kizer, Director of
the State Department of Health Services (DHS) , which discusses
conditions under which the DHS would likely accept "fair-share"
limitations in county hazardous waste management plans. The DHS
letter, dated October 6 , 1989, suggests a new policy direction
for the DHS on "fair-share" proposals in the County plans. The
letter was discussed by the Hazardous Materials Commission at
their October 25 , 1989 , meeting. The Commission believes that
the Contra Costa County Hazardous Waste Management Plan
incorporates many of the concepts outlined in the DHS letter.
The Commission concluded that further discussions with the DHS
will be necessary to clarify their position.

The October 6, 1989, letter requires counties to notify the State
Department of Health Services by November 1 , 1989, if they wish
to modify the county hazardous waste management plans to include
the concepts outlined by Mr. Kizer.
The Hazardous Materials Commission recommends that the Board
authorize the Chair to send a letter to the State Department of
Health Services by the November 1, 1989, deadline. Although the
Commission believes that many of the State' s "fair-share"
concepts are included in our County' s Hazardous Waste Management
Plan, they recommend that the Board respond to the State so that
further discussions can proceed.
