SPECIFIC REQUEST(S) OR RECOMMENDATIONS(S) & BACKGROUND AND JUSTIFICATION RECOMMENDATIONS Approve reimbursement of Pleasant Hill BART Specific Plan fees and authorize the Auditor-Controller to issue a warrant to MSM Development Corporation. FISCAL IMPACT None. . The ' funds necessary for this reimbursement have been provided to the Agency by the Flood Control District. BACKGROUND/REASONS FOR RECOMMENDATIONS The Developer of subdivision 6939 has a Pleasant Hill BART Station Specific Plan fee obligation of $117 ,747. 00. This fee was to be applied towards the installation of a portion of Line C as shown in Drainage Area 44B plan. The cost of this Line C plus other improvements and programs provided for by the Developer .resulted in an over payment of $41,000 .75. The primary factor contributing to this was the cost of Line .0 in Drainage Area 44B. Therefore the Flood Control District has transferred $41;000.75 to the Pleasant Hill BART construction fund of the Redevelopment Agency in order to ' affect a reimbursement to the Developer for excess expenditures. The Developer is MSM Development Corporation, P.O. It is the intent of the Flood Control District that this fee, in its entirety, be applied toward the installation of a portion of Line C as shown on the Drainage Area 44B plan. Some of the original fee obligation was used for purposes other than the actual construction of Line C. The following distribution of the fee occurred. This effectively reduced the total fee available for the Line C installation: Fee Distribution Pleasant Hill BART Station Fee $117,747.00 TSM Fee (15,038.10) Oak Road Construction Costs (9,085.24) Design, Plan Check and Inspection (16,877.41) Funds available for Line C Installation $76,746.25 In order to apply the full amount of the fee obligation to the construction of Line C, the developer should be repaid for those expenditures that were used for purposes other than the construction of Line C. These expenditures have been identified as TSM Fee ($15,038.10) , Oak Road Construction Costs ($9,085.24) , and Design, Plan Check and Inspection ($16,877.41) for a total of $41,000.75. At this time, the Flood Control District is prepared to transfer funds in the amount of $41,000.75 from the Drainage Area 44B fund to the Pleasant Hill BART Station Construction Fund. The Pleasant Hill BART Station Fund can then in turn return these funds to the developer for these excess expenditures.
