Spooner , Contracts Administrato Costa DATE: October 16, 1989 County SUBJECT: Retroactive Payment to CuraCare SPECIFIC REQUEST(S) OR RECOMMENDATION(S) & BACKGROUND AND JUSTIFICATION I . RECOMMENDED ACTION : Ratify purchase of services from CuraCare in excess of the payment limit of Contract #26-177 (as amended by Contract Amendment Agreement 426-177-1 ) for services provided prior to August 31 , 1989 and authorize the County Auditor-Controller to pay the outstanding balance , not' to exceed $6 ,000 for said services . II . FINANCIAL IMPACT : The twelve-month payment limit of Contract 426-177 (effective September 1 , 1988 through August 31 , 1989 ) , as amended by Contract Amendment Agreement 426-177-1 , was $40 ,000 . Approval of this Board order will increase the Contract Payment Limit to $46 ,000 . Funding for this additional payment was considered by the Health Services Department and is included in the Department ' s current Fiscal Year Budget . III . REASONS FOR RECOMMENDATIONS/BACKGROUND : In September 1988 , the County Administrator approved , and the Purchasing Agent executed , Contract 426-177 with CuraCare , effective September 1 , 1988 through August 31 , 1989 , for pro- vision of ultrasound diagnostic testing and interpretation services for patients at Merrithew Memorial Hospital . On May 2, 1989 , the Board approved Contract Amendment Agreement #26-177-1 which increased the payment limit of Contract #26-177 from $15 , 000 to $40 , 000 . During the term of the contract , ultrasound services were requested as needed by County staff and provided by the Contractor in good faith . Because of administrative oversight by both the County and CuraCare , use of these services exceeded the final contract payment limit by $6 , 000 . The Health Services Department is requesting that the amount due CuraCare be paid . This can be accomplished by the Board of Supervisors ratifying the actions of County employees ' in obtaining provision of ultrasound services of a value in excess of the contract payment limit . This will create a valid obliga- tion on the part of the County , retroactively authorizing all payments made by the Auditor-Controller up to now, and authorizing payment of the balance .
