Bragdon, Director of Community Development DATE: 22 September 1989 SUBJECT: Recommendation from County Planning Commission to DENY Application by BRUDIGAM DEVELOPMENT, INC. (Applic/Owner) 2826-RZ & Final Develop- ment Plan #3048-88 for a 14 unit apartment complex - Walnut Creek area. (S.D. III)* Parcel #172-012-006. SPECIFIC REQUEST(S) OR RECONNENDATIONS(S) & BACKGROUND AND JUSTIFICATION RECOMMENDATIONS 1. Accept the environmental review documentation for this project as being complete and adequate. 2. Deny the appeal and uphold the decision of the Contra Costa County Planning Commission as per findings stated in Resolution. BACKGROUND/JUSTIFICATION FOR RECOMMENDATION: The matter was heard by the County_ Planning Commission on August 8, 1989. The Commission voted unanimously (One Abstention, Two Absent) to DENY the request. Reasons for the Commission's Denial follow: 1. The Contra Costa Consolidated Fire District was unable to provide assurance that the site is accessible to their equipment. Fire Inspector Chester Nelson, in a letter to the Community Development Dept. , dated 1/19/89, set forth the conditions under which the district could approve the project, several of which were not met 'by the project's designers. Tele- phone conversations with Inspector Nelson failed to convince staff that this problem could be overcome. That is why the Staff Report concluded (Part VII, General Discusion, Conclus- ions, as follows: "Provided the fire district is satisfied that the fire hazard can be controlled even though some equipment cannot gain immed- iate access because of insufficient turnaround area, the develop- ment should be approved. " 2. The presence of a very large specimen oak tree partially blocks the access roadway, posing a barrier to fire development equipment. Also, the Commission was concerned that the health of the tree might be threatened, particularly in the event that fire equipment in the process of gaining access to the development in an emergency, might have to re- move the large limb overhanging the access road to facilitate frequent passage of tenants' vehicles could be detrimental to the tree. 3. The project's design did not impress the Commission as exceptional that rezoning to Planned Unit District (P-1) was justified. Additionally, i` was noted that the P-1 District minimum area standard of 5 acres is not met by the .55 acre Brudigam project. The applicant has informed staff that they intend to submit additional material supporting their application. They have requested that the Board of Supervisors consider this material in their review. However, such material has not been received as of the date of this Board Order. (applicant and owner) (2826-RZ) requesting approval to rezone 0.55 acre of land from Single Family Residential District (R-15) to Planned Unit District (P-1) and for approval of Development Plan #3048-88 for a 14 dwelling unit apartment complex in the Walnut Creek area. Harvey Bragdon, Director, Community Development Department, advised the Board of- new information that had been provided that would help the County Planning Commission in its deliberations on this matter and recommended that because of this new information that the matter be referred back to the County Planning Commission for hearing. There being no one present who disagreed with the recommendation, IT IS BY THE BOARD ORDERED that the above matter is REFERRED to the Contra Costa County Planning Commission.
