RECOMMENDATION
Acknowledge receipt of the attached Report #11 from
O'Brien-Kreitzberg & Associates for the month of June 1989 on the
status of construction work at the County' s detention facilities.
BACKGROUND-
The attached Report #11 outlines the status of work at the West
County Justice Center which is on schedule and within budget with
a projected completion date of May 2, 1990, Marsh Creek Detention
Facility which was completed and certified for occupancy April
21, 1989 and actually occupied April 23 , 1989 within budget and
on the Main Detention Facility which is behind schedule due to
contract negotiation problems but which is forecast to remain
within budget. A new project schedule is being developed for the
MDF which will call for vacating M and F modules, one at a time,
and for construction to occur in December and January, when the
inmate population is at its lowest. There are still problems
with the fire flow at Marsh Creek which does not meet minimum
requirements. The most cost-effective solution to this problem
is being sought.

EXECUTIVE SUMMARY
A. INTRODUCTION:
This report is subdivided into three major sections: 1) Executive Brief and
Summary, 2) Detailed Schedule and Financial Information and 3) Attachments.
It describes the design and construction progress for the West County
Justice Center, Marsh Creek Detention Facility and Martinez Detention
Facility achieved during the period of June 1989 as well as Areas of
Concern.
B. GENERAL:
1. West County Justice Center
a. Environmental Lawsuit
The consulting environmental firm will begin work in early July. A
meeting at the site has been scheduled for July 14.

1. West County Justice Center
a. Desi
Meetings were held with the Architect to review the equipment,
signage and furnishings 509, progress set on June 6 and 14. The
equipment 90% progress submission was received on June 30.
b. Construction:
1) Contract A: Substantially complete.
2) Contract B: Construction contract critical activity were
construction of the second floor slab at the Administration
Building and second floor exterior concrete block walls at
Housing Buildings No. 6, 7 and 8. Schedule status was as
follows:

The Contractor continues to correct "punch list" and warranty
items including final grading of the bank west of the dorms. A
Notice of Completion will be presented to the Board of
Supervisors on July 11.
3. Martinez Detention Facility
a. Design
A set of 50% complete .contract documents were submitted for the
County's review on June 16. A set of these drawings will be
forwarded to the Board of Corrections for review concurrent with
County review.

E. MAJOR AREAS OF CONCERN:
1. West County Justice Center:
♦ Contract B: Walsh Construction Company
a. Stop Notice Against the Glazier Subcontractors:
Issue: A Stop Notice was filed by the Glaziers, Architectural
Metal and Glass Workers' Trust Funds against the subcontractor,
for their failure to pay glazier's fringe benefits to the Fund.
Action: The CM has instructed the general contractor to enforce
payment immediately. The amount claimed in the stop notice will
be withheld from the June 1989 Progress Payment.
b. Toilet Accessories Claim:
Issue: The Contractor submitted a manufacturer which was not
approved and the AE rejected the proposed manufacturer. The
Contractor has indicated a $17,000 - $19,000 claim if the
specified brand must be used.
Action: A CM decision was issued on May 26 rejecting the
alternate manufacturer and the claim.
C. Kitchen Carts:
Issue: The cart revised design changes have still not been
finalized. Impact of cart delivery is unknown but is becoming
critical since the AE has not responded in over 111 days.
Action: The CM has directed the Architect to expedite this
change. AE states lead time for production of carts is 90 days.

Contract B: Walsh Construction Company(Cont'd)
d. Roof Curb Claim:
Issue: The Contractor contends that (1) the contract structural
drawings fail to show all openings required for mechanical
penetrations; and (2) curb framing around openings lack
structural supports. The Contractor issued a request for time
with no specific date.
Action: The Contractor's contention regarding the openings was
rejected by the CM and AE; ,the Contractor has stated his
intention to claim. The structural supports for the curb framing
were determined by the AE and the CM as missing from the contract
drawings. The CM has directed the Contractor to provide the
supports on a time and material basis in order not to delay the
work. A CM decision was issued on June 14 denying the request
for time.
e. Weed Claim:
Issue: The Contractor has claimed the weeds growing on site are
the responsibility of the County.
Action: The CM has rejected the claim with a final decision
issued on April 26. Since the Contractor has not responded, he
has waived his right to the claim.
f. Duress Alarms:
Issue: The County has requested additional duress alarms, the
result of reviewing the control panel shop drawing submittal.
Action: CM has issued a request for pricing to the Contractor.
g. Roof Beam Slope Claim:
Issue: The Contractor claims that the roof beam slope in
Buildings 1, 2 and 4 were not clearly noted on the. structural
plans. It is the CM and AE interpretation that the drawings
clearly show elevations and provide for a standard detail.
Action: On May 26, a CM final decision was issued denying the
Contractor's claim for $6,000±.

h. Key Switch Claim:
Issue: The Contractor claimed that the hardware drawings do not
indicate the cell door key switches. It is the AE and CM
interpretation that the key switch is shown in the Division 17
(Security) specification.
Action: On June 9, a CM final decision was issued denying the
Contractor's claim. Note that no price was given by the
Contractor.
i. Structural Openings Claim:
Issue: The contractor claims that the structural steel for small
openings are not shown on the steel plans. It is the CM and AE
interpretation that the documents provide details for small
openings which are to be used as required.
Action: On June 7, a CM decision was issued denying the
Contractor's claim. Note that no price was provided by the
Contractor.
j. Embed Delay Claim:
Issue: The Contractor claims that the lack of masonry embeds
caused a delay until the Architect's clarification was provided.
Action: The Contractor's claim for 13 days was denied based on
the lack of schedule information.
k. Roofing:
Issue: In order to provide the required guarantee the Contractor
states that the specified roofing manufacturer requires roofing
details different than shown on the drawings.
Action: The Architect modified the curb design to add a direct
attachment of roofing to wood in lieu of metal and a change was
issued.

a. Fire Service
Issue: A new 8" fire main and two new fire hydrants were
installed as required by code; however, fire flow does not meet
minimum requirements.
Action: The fire district, water district, design engineer and
CM met on May 2 to review engineering options. A follow up
meeting with Water District is pending.

SCHEDULE ANALYSIS
1. GENERAL:
The detailed schedule report is subdivided by three projects: 1) West
County Justice Center, 2) Marsh Creek Detention Facility and 3) Martinez
Detention Facility. The three projects are further divided into the design
and construction phases. The design portion will include general design
data and a progress narrative. The construction section will be subdivided
by each contract and will provide contract data, a progress narrative, plus
a bar chart.
2. West County Justice Center
a. Design:
The furniture, equipment and signage 507 complete Contract Documents
submittal was reviewed in June. The equipment submittal review
comments were issued on June 6, and those comments to the signage
submittal were issued on June 14. The furnishings submittal comments
will be issued in early July. The signage work will be bid as one
contract, while the furnishings and equipment will be broken into
several small procurement packages corresponding to product lines.
The County will be responsible for procurement.
b. Construction:
The West County Justice Center project includes two contracts:.
1) The first contract was for the rough grading of the project site
(Contract A), which is substantially complete.
2) The second is for the construction of the detention facility
(Contract B).

b. Building Two (Medical/Dental/Library/Classroom Building): Ahead of
schedule. The current critical activity is structural steel which is
about 952 complete.
C. Building Three (Multi-purpose Building): Ahead of schedule. The
current critical activity is masonry which is scheduled to start in
early July.
d. Building Four (Intake Housing/Central Visiting): Ahead of schedule.
The current critical activity is masonry. The masonry is scheduled
for completion in mid-July.
e. Building Five (Inmate Housing): On schedule. The current critical
activity is roof embeds. The roof embeds are scheduled for completion
in mid-July. One activity of concern that is becoming critical is
the electronic equipment. The equipment is currently in the shop
drawing stage for fabrication and delivery in mid-November. To meet,
that delivery, all equipment should be on order which is not the case.
We have directed the Contractor to give us a more detailed breakdown
of the electronic equipment schedule and updated status of the
equipment orders and delivery schedules. This concern applies to all
four general population inmate housing.
f. Building Six (Inmate Housing): On schedule. The current critical
activity is roof embeds which are scheduled for completion in
mid-July.
g. Building Seven (Inmate Housing): On schedule. The current critical
activity is metal decking which is scheduled for completion in
mid-July.
h. Building Eight (Inmate Housing): Behind schedule. The critical
activity is metal roof decking which is scheduled for completion in
mid-July. The follow-up activity, insulated concrete roof deck
system, may delay this building. This activity was to have occurred
concurrent with the similar Building Six activity, but the Contractor
has unilaterally decided to charge the logic of the schedule and do
this activity sequentially after Buildings Five, Six and Seven. The
change was made to shorten the duration of this activity, so that,
Five and Six could be completed early and hopefully Seven and Eight
completed on time. We will watch this activity closely.
3. PROGRESS BAR CHART:
A progress bar chart is included to this report (Attachment D). It
compares the actual physical progress of field activities to their
scheduled progress. Procurement items are not included. As of the end of
June, the overall progress of the project is 45.5%.

4. AREAS OF CONCERN:
a. Modification of Schedule Logic:
Issue: The Contractor has changed the logic of the schedule.
Previously they had two housing units working concurrently, but now
they have scheduled all housing working sequentially. To reduce the
time increases caused by these changes, they have reduced the
durations of many activities. Because of these changes, we are very
concerned that these buildings will not be roofed by the rainy season
and consequently completed within the contractual time limits.
Action: We have directed the Contractor to submit a schedule
incorporating these changes for our review and approval. We have also
identified four activities to schedule and monitor on a short term
basis while the schedule is being updated. Those activities are:
i) Insulative Concrete Roof System
ii) Fire-Proofing
iii) Mechanical, Electrical and Plumbing Rough-In
iv) Built-Up Roof
b. Procurement and Installation of the Security System:
Issue: Our analysis of the schedule and the progress of work shows
that the procurement of the security system will impact the completion
of the project if not corrected now.
Action: We have directed the Contractor to subdivide his schedule of
the procurement of the security system so that we may identify and
correct those specific items that will impact the completion.

1. General:
The detailed financial report is divided into three projects: 1) West
County Justice Center, 2) Marsh Creek Detention Facility and 3) Martinez
Detention Facility. The projects are further divided into the Design and
Construction phases. The Design portion will include a narrative. The
Construction section will be subdivided by each contract and will provide
contract data, where available, narratives and cost curves.
2. West County Justice Center
a. Design:
The Architect's basic fee is $2,705,923 of which $2,424,163 (907) has
been paid. In addition, the Architect has been authorized $376,020 for
extra services, of which $255,472 (687) has been paid.
b. Construction:
The West County Justice Center financial report includes two contracts:
1) The first contract was for the rough grading of the project site
(Contract "A") which is substantially complete.
The remaining contingency for Contract "A" is <$2,150.
2) The second contract is for the construction of the detention
facility (Contract "B").
The remaining contingency for Contract "B" is $927,966.

report date (6/25/89) to the Contractor's forecast progress. The
Contractor's forecasts (early start forecast and late start forecast) are

12/23/88 revised baseline schedule. The actual value of base contract work
