Contract Amendment for Rate Regulation of Acme Transfer Station SPECIFIC REQUEST(S) OR RECOMMENDATION(S) & BACKGROUND AND JUSTIFICATION RECOMM]MATION Authorize Chair to execute_ an amendment to the Consulting Services Agreement with Touche-Ross to include an adjustment of the Interim Transfer Station Rate Regulation Model to provide for segmentation of Acme' s cost, additional analysis to evaluate closure cost assessment. options and provision of services for unanticipated and out-of-scope work. FINANCIAL IMPACT - The current contract limit for the Transfer Station Rate Regulation Program, review of closure and post-closure costs, the identification of historical users of the landfill, review of the landfill disposal fee, and analysis of the historical profit levels of Acme Landfill is $176,608. The requested additional cost for this amendment of $127,459. The revised total contract payment limit is to be increased to $304 ,067 . The additional cost will be recovered from the Acme Fill Corporation. Acme' s cost for both these projects will be considered an eligible expense ' to be incorporated into the rates at the landfill and transfer station. REASONS FOR RECOMMENDATION/BACKGROUND on March 21, 1989 the Board of Supervisors approved a contract with Touche-Ross to establish a rate review program which requires approval of disposal rates by the County for fees charged at the Acme Interim and Permanent Transfer Station. On April 11, 1989 the Board authorized an amendment to the agreement to include a closure and post-closure cost review for Acme Landfill. On June 6, 1989 the Board authorized an amendment to the agreement to include identification of historical users of Acme Landfill and a review of the major components of the $47 per ton disposal fee,. to determine if the cost components. are reasonable. CLERK OF THE BOARD OF Solid Waste Commission Auditor-Controller SUPERVISORS AND COUNTY ADMINISTRATOR 414f M ©Y 382.7-83 v Z Dom- DEPUTY r Staff has negotiated an amendment to the agreement with Touche- Ross to adjust the interim transfer station rate regulation model to provide for segmentation of Acme' s costs into a transfer operation, landfilling, closure and post-closure costs, and other operating costs. This will allow the Board the future option to regulate the entire Acme operation including the landfill. Also, Touche-Ross was requested to work with County staff and city/ district staff to analyze and evaluate closure cost assessments ' options including methods to lengthen the time period to reduce the per-ton assessment of closure and post-closure costs. During the development of all the work associated with this project there were many cases of work unanticipated in the proposals received from Touche-Ross, as well as work that was out-of-scope. The contract allows for re-negotiation of the contract under these circumstances. Touche-Ross has agreed to accept 50-percent payment for unanticipated and out-of-scope work. This amendment reflects the 50-percent sharing of these costs. jl26:acm.brd
