MICHAEL WALFORD, PUBLIC WORKS DIRECTOR ENGINEER DATE: October 10, 1989 SUBJECT: Railroad agreements with Atchison, Topeka and Santa Fe Railway Company and Southern Pacific Transportation Company for work to be performed in conjunction with the Nichols Road Overhead Replacement Project. Project Number 0662-6R4132-87 Specific Request(s) or Recommendation(s) & Background & Justification I. RECOMMENDED ACTION: APPROVE the Cost and Maintenance Agreement with the Atchison, Topeka and Santa Fe Railway Company (ATSF) for work to be performed by ATSF in conjunction with the Nichols Road Overhead Replacement Project; APPROVE the Construction and Maintenance Agreement with Southern Pacific Transportation Company for work to be performed by Southern Pacific in conjunction with the Nichols Road Overhead Replacement Project; and AUTHORIZE the Chair of the Board of Supervisors to execute the agreements. II. FINANCIAL IMPACT: There is no impact to the County General Fund. The Nichols Road Overhead Replacement Project is funded by General Chemical Corporation, Chevron U.S.A. , Inc. and Allied Signal Corporation (20%) and Federal funds (80%) . The estimated cost of the work to be performed by the railroad companies is $11, 512 for ATSF and $52 , 396 for Southern Pacific. REASONS FOR RECOMMENDATION/BACKGROUND: The existing Nichols Road Overhead is in poor condition and qualified as a Federal Highway Bridge Replacement project in 1986. The project will provide a new grade separation structure spanning the Southern Pacific Transportation Company tracks on Nichols Road. The structure serves General Chemical Corporation, Chevron U.S.A. , Inc. and Allied Signal Corporation who have agreed to provide the local share. The project requires modifications to the ATSF at grade crossing as • well as to the Southern Pacific undercrossing. Both railroad companies have agreed to perform the work within their rights of way and the County has agreed to reimburse them for the costs incurred. IV. CONSEQUENCES OF NEGATIVE ACTION The project cannot be constructed without modifications to the railroad facilities. Failure to approve and execute these agreements will delay construction indefinitely and the County will lose both the Federal and local funding for this project.
