SUBJECT: REPORT ON LITTER-RELATED ISSUES

RECO1Il4ENDATIONS
1. Request the Sheriff-Coroner to advise our Committee on
October 23 , 1989 on what steps he has taken to vigorously
enforce the covered load requirements .of Vehicle Code
Section 23115 and County Ordinance Code Section 418-2. 008,
both of which require that any vehicle used to haul garbage
or refuse be completely covered so that its contents do not
drop off the truck onto the highway.
2. Request the Health Services Director to prepare a report to
be presented to our Committee on October 23 , 1989 which
outlines which jurisdictions in the County have a mandatory
solid waste collection ordinance in force and which do not.
3 . Request the Health Services Director and County
Administrator' s Office to jointly develop a program and
budget using students or Work Alternative Participants to
travel throughout the County identifying addresses which
appear to be having specific litter problems and report them
to the appropriate County staff to follow-up and enforce the
County' s ordinances in regard to littering.
4. Leave on referral to our Committee the three items noted
above, but remove all other litter-related referrals
pertaining to the Health Services Department which were
referred to our Committee on December 20, 1988.

BACKGROUND:
On December 20, 1988 the Board of Supervisors referred to our
Committee a status report from the Health Services Director on a
number of litter-related referrals which had occupied the 1988
Internal Operations Committee for a good part of the year. We
reported to the Board on this matter on April 18 , 1989.
On September 25, 1989 we received a further status report from
the Health Services Department, a copy of which is attached to
this report. There are three areas on which we wish to follow-up
further with County staff, but most of the Health Services
related items appear to be well under control at this time.
We continue to be concerned about the fact that reports of
uncovered rubbish loads continue to come to our attention,
requiring a tremendous effort on the part of Cal-Trans and
many other agencies just to keep our streets and highways
from being covered with trash. We are, therefore, asking
the Sheriff to share with us what efforts he is making to
enforce the covered load requirements of state law and
county ordinance.
It appears from a preliminary report we received on September 25
from Jim Blake of the Health Services Department that many local
jurisdictions now have mandatory garbage service subscription
ordinances in place. We would like to see a comprehensive list
of all jurisdictions and which do and do not have such mandatory
subscription ordinances in place.
Finally, Mr. Blake shared with us the fact that the Health
Services Department hires several college students each summer to
inspect public swimming pools. Mr. Blake notes that a similar
program might allow the County to undertake a more aggressive and
proactive program to identify residents who are accumulating
large quantities of trash in their yards or which are the site of
other nuisances. Mr. Gregory from the County Administrator' s
Office noted that the Sheriff ' s Work Alternative Program might
also be a good source of labor to undertake such a proactive
program. We are, therefore, asking Mr. Blake and Mr. Gregory to
jointly outline such a program for our Committee and return a
detailed proposal to us.

Mr. C. L. Van Marter' s memo dated 7/5/89 directed us to provide a
status report on litter-related referrals made to the Health
Services Department. Our responses are described below in the same
order as listed in Mr. Van Marter' s 7/5/89 memo:
April 19, 1988 and May 17 , 1988 - Mandatory Subscription
Health Services has received lists of and communicated with all
non-subscribers in the following areas :
Bay View Refuse - Kensington
East Bay Sanitary - El Cerrito
Martinez Sanitary - Martinez area
Valley Disposal - Walnut Creek
Pleasant Hill Bayshore - Martinez, Pacheco and Rodeo areas
only.
Communities for which we have been unable to obtain lists of
non-subscribers include the following:
Antioch, Concord, Brentwood, Clayton, Danville, Alamo, San
Ramon, Lafayette, Pittsburg, West Pittsburg/Shore Acres, Byron,
Knightsen, Alamo & all of West County except Rodeo, Kensington, and
E1 Cerrito.
August 2 , 1988 - Permits for Refuse Transporters
Approximately 30 permits were prepared, submitted to the Board
and issued. In the near future we plan to again review telephone
directories, newspaper ads and other publications to determine if
additional transporters should be permitted.

Ordinances
The Health Services Director did write to the Solid Waste
Commission requesting the Commission to offer county services in
enforcement of a city mandatory subscription ordinance . The
Commission did communicate with the cities and to date none of the
cities have requested our assistance .

2 , 1988 .

August 2 , 1988 - Intensified Effort to Enlist The Assistance of the
Franchisors and Collectors in a Mandatory Subscription Program
The letter requested by your committee was mailed on 8/22/88 .
August 2 , 1988 - Submit Status Report on 10/24/88
The status report was submitted as directed.
November 1 , 1988 - Submit status report on 12/12/88 .
Discussion of Mandatory Subscription
1 . As previously noted we have not received lists of
non-subscribers for a number of communities .
2 . Of the non-subscribers we contacted, most of them are doing
an adequate job of handling their wastes . It should be noted that
we do not yet have lists of non-subscribers for the areas that
evidence the most serious waste handling problems .
3 . A number of persons who received our compliance letter were
very irate because they are doing a good job with source
reduction and resource recovery.
4 . The collectors do not maintain lists of non-subscribers .
Preparation of the lists is a time consuming manual process . By the
time we receive and process a list conditions have changed
significantly because of property sales, new customers subscribing
to collection service and others cancelling their subscription.

5 . The solid waste complaints we investigate are almost
exclusively problems that cannot be resolved by requiring the
property owner to subscribe to standard pickup service .
6 . There are some areas where one collector serves one side of
a street and another collector serves the other side. This has
caused some confusion because property owners were referred to the
wrong collection company.
