Notice of hearing was duly given in accordance with Government Code Sections 54986, 54992 and 65962 ; and This matter came on for hearing before this Board at a regularly scheduled meeting on January 31, 1989. This Board hereby DETERMINES that it can be seen with certainty that there is no possibility that increasing the fees for the Crow Canyon Road Extension Area of Benefit as recommended by said Revisions to the Development Program Report may have a significant effect on the environment; therefore, the project is not subject to the California Environmental Quality Act pursuant to Section 15061(b) (3) of Chapter 3 of said Act's guidelines. This Board hereby APPROVES and ADOPTS said Revisions to the Development Program Report attached hereto as Exhibit "A" filed January 11, 1989, including its updated data on approved and estimated costs, development potential, cost allocation, and revised fee schedule. This Board further ADOPTS as its findings in support of this Board's actions herein the statements and determinations set forth in said Revisions to the Development Program Report attached hereto as Exhibit "A" . This Board hereby INTENDS to adopt the following increased fee schedule by ordinance, as recommended in said Revisions to the Development Program Report: ,_Residential single-family, $1715/ dwelling unit; Residential multi-family, $1372/dwelling unit; Commercial, $1. 65/square foot gross floor area; and Office, $1.95/square foot gross floor area: This Board hereby DIRECTS that the Public Works and Community Development Departments shall continue to periodically review final costs and final approved entitlements within the boundaries of the Area of Benefit as originally established by County (and more particularly described in Exhibit "B" attached hereto) and shall recommend to the Board of Supervisors for consideration adjustment of said fees in accordance with Resolution No. 86/36 (Jan. 28, 1986) , Ordinance No. 86-11 (Feb. 4, 1986) , the "Joint Exercise of Powers Agreement (Crow Canyon Road Extension Fee RESOLUTION NO. 89/61 RESOLU ;'f Board of Supervisors January 31, 1989 Page Two Benefit Area) " between the County and the Cities of Danville and San Ramon, dated February 10, 1987 (Resolution No. 87/70) , Resolution No. 87/510 and Ordinance No. 87-71 (September 29, 1987) , and this Resolution No. 89/61 and Ordinance No. 89-10 (January 31, 1989) . IT IS ORDERED that Ordinance No. 89-10 giving effect to the increased fees for the Crow Canyon Road Extension Area of Benefit is introduced for adoption and reading waived pursuant to Government Code Section 25131. The Crow Canyon Road Extension Area of Benefit was established by the County in early 1986 (Resolution No. 86/36, adopted January 28, 1986; Ordinance No. 86-11, adopted February 4, 1986) for the purpose of reimbursing Blackhawk for 100 percent of the cost of constructing the two lane road to Camino Tassajara Road and 75 percent of the cost of the specified signal installations. A Reimbursement Agreement (Crow Canyon Road Extension) between Blackhawk and the County was adopted by the Board September 16, 1986 (Resolution No. 86/560) . Thereafter, Blackhawk completed construction of the Crow Canyon Road Extension. Ordinance No. 86-11 established the initial fee schedule to be levied and collected within the Fee Benefit Area and provided that final fees are "subject to annual review of final costs and final approved entitlements in Fee Benefit area by Contra Costa County". Pursuant to this fee adjustment mechanism, the amount of the fees is not subject to any cap, but rather will increase or decrease depending upon the updated costs and land use entitlements. Pursuant to Ordinance No. 86-11 and the above referenced resolutions, for those developments requiring a final or parcel map, the fees are to be collected prior to the filing of a final or parcel map and for all other developments the fees are to be collected prior to issuance of a building permit. Effective February 10, 1987 (Resolution No. 87/70) , the County, the Town of Danville and the City of San Ramon entered into a "Joint Exercise of Powers Agreement (Crow Canyon Road Extension Fee Benefit Area)" providing for the functional continuation of the Fee Benefit Area established by County within any property located within the boundaries of the Fee Benefit Area that might be subsequently annexed to either city. Some of these properties have already been annexed to Danville and San Ramon. Pending development projects within the Fee Benefit Area have been appropriately conditioned in accordance with the Joint Exercise of Powers Agreement (February 10, 1987) . The Joint Exercise of Powers Agreement (February 10, 1987) provides that the review and approval of costs incurred by Blackhawk and the adjustment of the Fee Benefit Area fees to reflect final costs and entitlements are to be determined exclusively by the County. It should be noted that the fee adjustment mechanism established in Ordinance No. 86-11 and continued in the Joint Exercise of Powers Agreement (February 10, 1987) was not in any way modified or superseded by the provisions of the later "Joint Exercise of Powers Agreement - Tassajara Transportation Improvement Fees" between the County, Danville and San Ramon (Board Order No. 1.097, April 28, 1987) . A-2 As a result of the first annual review of costs and land use entitlements for the Fee Benefit Area, by Board of Supervisors Resolution No. 87/510 and County Ordinance No. 87-71 (both adopted September 29, 1987) , the County after conducting a duly noticed hearing, revised the fees as set forth therein. As required by Resolution No. 87/510, certified copies of Resolution No. 87/510 and Ordinance No. 87-71 were recorded with the County Recorder against all properties within the Fee Benefit Area (recorded October 7, 1987 as Series 87-217542 and 87-217543, respectively) . As set forth in this report, since the completion of the first annual review, there have been some reductions in approved residential and office densities within the Fee Benefit Area. Further, as also described in this report, updated cost information is available, and some Fee Benefit Area fees have been collected and paid over to Blackhawk. Pursuant to the annual review procedure discussed above and in order to ensure that Blackhawk is reimbursed for its costs, it is necessary to again revise the Fee Benefit Area fee schedule based on updated cost and land use information and reimbursement sums received by Blackhawk through December 31, 1988. This report contains revisions to the Development Program Report for the Craw Canyon Road Extension Area of Benefit, adopted by the Board of Supervisors January 28, 1986 (Resolution No. 86/36) , and first revised in connection with the first annual review (Resolution No. 87/510) . Only the sections included in this report have been revised. The remainder of the original January 28, 1986 report, as revised by the report adopted September 29, 1987 (Resolution No. 87/510) , is unchanged and remains fully effective. The revised Fee Benefit Area fees as recommended in this report are exempt from the requirements of "AB 1600" (starting at new section 66000 of the Government Code) because, as described above, these fees are imposed pursuant to a reimbursement agreement between the County and Blackhawk for the costs of the Crow Canyon Road Extension and specified traffic signals, which exceeded the need for these public facilities attributable to and reasonably related to the Canyon Lakes Development, and because these fees are also collected in accordance with the various development agreements between the developers of the Fee Benefit Area projects and the County, Danville or San Ramon. Ft. $1.85 $1.95 gross floor area The revised fees are to be used for reimbursing Blackhawk for the costs of installing the road and signal improvements described in the original Development Program Report (adopted January 28, 1986) , which is incorporated herein by reference. As described in the original Development Program Report, the need for such installation is attributable to increased vehicular traffic (measured in trip generation rates) generated by the various types of development (residential, commercial, and office) comprising the area of benefit. The proportionate share of such required improvements and installation costs for each type of development within the area of benefit is also described in the original Development Program Report, as revised by this report. This Ordinance provides for an increase in the fees to be collected from developments within the boundaries of the Craw Canyon Read Extension Area of Benefit as originally established by County to fund the ' extension of Crow Canyon Road. This Ordinance is enacted, in part, pursuant to the following authorities: (1) Resolution No. 86/36 (January 28, 1986) and Ordinance No. 86-11 (February 4, 1986) ; (2) the Reimbursement Agreement between Contra Costa County and Blackhawk Corporation dated September 16, 1986 (Resolution No. 86/560) ; (3) the Joint Exercise of Powers Agreement between Contra Costa County, the City of Danville and the City of San Ramon, dated February 10, 1987 (Resolution No. 87/70) ; (4) Resolution No. 87/510 and Ordinance No. 87-71 (September 29, 1987) ; (5) Resolution No. 89/61 (January 31, 1989) ; and (6) Government Code Sections 54986, 54992 and 65962. This Ordinance was adopted pursuant to the procedures set forth in Government Code Sections 54986, 54992 and 65962, and all required notices have been properly given and public hearings held. Section IV of Ordinance No. 86-11 and Ordinance No. 87-71 is amended to read as follows: Revised Fee Adoption: The following revised fees and fee schedule are hereby ADOPTED for the Crow Canyon Road Extension Area of Benefit to fund the road extension in accordance with Resolution No. 86/36 (January 28, 1986) , Ordinance No. 86-11 (February 4, 1986) , the Reimbursement Agreement between Contra Costa County and Blackhawk Corporation, dated September 16, 1986 (Resolution No. 86/560) , the Joint Exercise of Pavers Agreement between Contra Costa County, the City of Danville and the City of San Ramon, dated February 10, 1987 (Resolution No. 87/70) , Resolution No. 87/510 and Ordinance No. 87- 71 (September 29, 1987) , Resolution No. 89/61 and this Ordinance 89-10 (January 31, 1989) , and shall be LEVIED and COr,rECIEn pursuant to the above authorities; final fees subject to annual review of final costs and final approved entitlements in the Fee Benefit Area by Contra Costa County: Residential Single Family $1,715/dwelling unit Residential Multi-Family $1,372/dwelling unit Oenmiercial $1.65/square foot of gross floor area Office $1.95/square foot of , gross floor area .q=C T V. SDLP ON VI. Continued Effectiveness. Resolution No. 86/36 (January 28, 1986) , Ordinance No. 86-11 (February 4, 1986) as amended hereby, the Reimbursement Agreement between Contra Costa County and Blackhawk Corporation dated September 16, 1986 (Resolution No. 86/560) , the Joint Exercise of Powers,Agreement between Contra Costa County, the City of Danville and the City of San Ramon, dated February 10, 1987 (Resolution No. 87/70) , Resolution No. 87/510 and Ordinance No. 87-71 (September 29, 1987) , as amended hereby, Resolution No. 89/61 (January 31, 1989) , and all actions taken in accordance with the foregoing authorities shall continue in full force and effect. Swam VII. severability. If any fee or provision of this Ordinance is held invalid or unenforceable by a court of competent jurisdiction, that holding shall not affect the validity or enforceability of the remaining fees or provisions, and the Board declares that it would have adopted each part of the Ordinance irrespective of the validity of any other part. SECTICK VIII. Effective Date. This Ordinance shall become effective 60 clays after passage and, within 15 days of passage, shall be published once with the names of the Supervisors voting for and against it in the San Ramon Valley Times, a newspaper of general circulation published in the County.
