GILBERT, DIRECTOR OF GENERAL SERVICES Contra Costa DATE: January 24, 1989 CoU* SUBJECT: REPLACEMENT OF FUEL TANKS AT FIRE STATION NO. 45, 33 ORINDA WAY, ORINDA (WH895B) SPECIFIC REQUEST(S) OR RECOMMENDATION(S) & BACKGROUND AND JUSTIFICATION I. RECOMME4DATION A. CONFIRM that an emergency existed and AUTHORIZE the Director of General Services, retroactively to November 28, 1988 , to proceed in the most expeditious manner, pursuant to Section 20134 of the Public Contract Code, to excavate, transport and dispose of approximately 167 tons of contaminated soil at Fire Station No. 45, 33 Orinda Way, Orinda. B. APPROVE Change Order No. 2 to the Contract dated June 28, 1988, for Replacement of Fuel Tanks at Fire Station No. 45, 33 Orinda Way, Orinda, with Diablo Tank & Equipment, Inc. , Martinez , as the most expeditious manner of correcting the emergency condition and AUTHORIZE the Director of General Services to execute the Change Order. II. FINANCIAL IMPACT: The cost of this work will not exceed $32,000. Funding will be covered by the Orinda Fire Protection District budget and/or a supplemental allocation from the Special District Augmentation Fund. III. REASONS FOR RECOMMENDATION/BACKGROUND: A. On June 28, 1988, the Orinda Fire Protection District, contracted with Diablo Tank & Equipment, Inc. of Martinez, for the removal and replacement of two underground fuel tanks and one underground waste oil tank. B. After the existing tanks were removed, the surrounding soil was tested and found to be contaminated with hydrocarbon products. Guidelines established by the San Francisco Bay Regional Water Board require that contaminated soil be removed and disposed of at an approved Class I disposal site. The extent and quantity of contaminated soil could not be determined until the soil had been removed and measured. The open pit created by the tank removal needed to be filled as soon as possible to permit continued operation of Fire District operations and services and to avoid danger to life or property. Consequently, the necessary excavation and disposal of the contaminated soil was started on November 28, 1988, and was accomplished by the tank removal contractor, who was already on the site and who was familiar with the disposal process and regulations. As soon as excavation of the contaminated soil was completed and the remaining soil was tested and found to be acceptable, the pit was quickly backfilled with imported fill material. D. The normal formal bid process would have required a two month delay in completing the work, which was unacceptable because of the open excavation and the need to restore full use of the facility. 26001BO1. 11B GB:pg Page 2 of 2
