SUBJECT: REVISION TO PUBLIC HOUSING ADMISSION AND OCCUPANCY POLICY:
OCCUPANCY STANDARDS
I. RECOMMENDED ACTION:
ADOPT the proposed revised Occupancy Standards for the Conventional Low Rent
Public Housing Program, as recommended by the Advisory Housing Commission.
II. FINANCIAL IMPACT:
None.
III. REASONS FOR RECOMMENDATION/BACKGROUND:
On October 4,' 1988 the Board of Commissioners adopted the Admission and
Occupancy Policy for the Low Rent Public Housing Program operated by the Housing
Authority of the County of Contra Costa.
During the Public Comment period, Contra Costa Legal Services expressed its
opinion that the Occupancy Standards (number of persons per bedroom) should be
revised to allow more persons to occupy a dwelling unit. In response to Legal
Services, the Board of Commissioners directed the Housing Authority to review its
occupancy standards and report back to them with any recommendations.
Recent guidelines for occupancy standards have been established by the State of
California Department of Fair Employment and Housing which permit two persons per
bedroom, plus one person for the entire unit. The occupancy regulations for the
Department of Housing and Urban Development require that in setting its occupancy
standards the Housing Authority must comply with requirements in State or Local Laws.
As currently written, the Housing Authority' s occupancy standards do comply with all
legal requirements of State and Local Law. However, the Housing Authority believes
it should revise its occupancy standards to be consistent with the guidelines
established by the State of California Department of Fair Employment and Housing and
the proposed revised Occupancy Standards of two persons per bedroom, plus one person
for the entire unit will allow the Housing Authority more flexibility in assisting
families with children.
The Housing Authority has contacted Legal Services on this issue and they
concur with the Department of Fair Employment and Housing bedroom occupancy
standards.

At its Regular Meeting on Monday, December 19, 1988, the Advisory Housing
Commission of the Housing Authority of the County of Contra Costa voted to recommend
adoption of the revised Occupancy Standards for the Conventional Low Rent Public
Housing Program.
