HomeMy WebLinkAboutMINUTES - 01171989 - 2.11 THE BOARD OF SUPERVISORS OF CONTRA COSTA COUNTY, CALIFORNIA Adopted this Order on _January 17, 1989_, by the following vote: AYES: Supervisors Powers, Fanden, Schroder, McPeak, Torlakson NOES: None ABSENT: None ABSTAIN: None ------------------------------------------------------------------ ------------------------------------------------------------------ SUBJECT: Siemens Medical laboratories, Inc. , Appeal The Board on December 13 , 1988 continued to this day decision on the request of Siemens Medical laboratories, Inc. , to waive the Countywide Area of Benefit traffic mitigation fee. J. Michael Walford, Public Works Director, commented on the delays incurred in processing the application of Siemens Medical Laboratories to build a manufacturing facility in the North Concord area. Mr. Walford .advised that in his review of this matter, he has determined that the appellant is entitled to partial refund of the fee he paid because of improvements made by Bedford Properties, the former owner of the property. He recommended that Siemens receive a refund of $100 ,607 of the fee paid. M. J. Pritchard, Attorney for the appellant, requested that the entire fee be refunded. He advised that the improvements had been constructed by Bedford. He referred to the challenge to the negative declaration of environmental significance resulting in the delay in obtaining the necessary building permits. He argued that since the property has been annexed to the City of Concord, the permits issued should be free from the County impact fee. Fred Egli, Director of Manufacturing, Siemens Medical Laboratories, Inc. , urged the Board to refund the entire fee paid by his company. Mr. Walford noted that the City of Concord has the same fee structure as Contra Costa County. He advised that Siemens would have had to have paid the fee to the City of Concord for traffic mitigation purposes if the permits had been obtained after the annexation occurred. He commented on the potential need for traffic signals to be installed at two intersections in this area. Supervisor McPeak advised of the need for traffic mitigation in the area as a result of development and the fee structure to accomplish this. She recommended that the request of Siemens Medical laboratories, Inc. to waive the Countywide Area of Benefit traffic mitigation fee be denied. She further recommended that the Public Works Director review with the City of Concord the issue of responsibility for traffic signals if required in the area; and that the Public Works Director meet with representatives of Siemens to discuss further a possible credit for mitigation improvements provided by the Bedford Corporation. Board members being in agreement, IT IS BY THE BOARD ORDERED that the recommendations of Supervisor McPeak are APPROVED.
