SUBJECT: Hearing on Rezoning Application #2787-RZ: The Appian May Group
(Applicant and Owner) to rezone subject site from (M-12) to (N-B).
The subject property is a 3.7 acre site fronting for 370 feet on the
westerly side of Appian May, approximately 70 feet south of Argule
Road, in the E1 Sobrante area.
SPECIFIC REQUEST(S) OR REC"ENDATIONS(S) & BACKGROUND AND JUSTIFICATION
RECOMMENDATIONS
1. Accept the environmental documentation prepared .for this
project as being adequate.
2. Approve the Rezoning application 2787-RZ.
3. Adopt the County Planning Commission' s findings as set forth
in Resolution No. 65-1988 as the determinations for this
actions.
4. Introduce the ordinance giving effect to the aforesaid
rezoning, waive reading and set forth date for adoption of
same.
BACKGROUND/REASONS FOR RECOMMENDATIONS
The Board at their December 13 , 1988 Hearing, heard this rezoning
request ( #2787-RZ) and declared their intent to approve the said
request. A companion General Plan request (County file #7-88-CO)
to designate the site public-semi-public. The rezoning conforms to
the General Plan designation for the site. Uses authorized or
proposed in the Land Use District are compatible with in the
District and to uses authorized in adjacent District. A Community
need has been demonstrated for the use proposed (a post office) .

On recommendation of Supervisor Fanden, IT IS BY THE BOARD ORDERED that
recommendations 1, 2, 3, and 4 are APPROVED; and as in recommendation 4,
Ordinance No. 89-6 is INTRODUCED, reading waived and January 24 , 1989 is
set for adoption of same.

RESOLUTION NO. 65-1988
RESOLUTION OF THE CONTRA COSTA COUNTY PLANNING COMMISSION OF THE STATE OF
CALIFORNIA, RECOMMENDING APPROVAL TO THE LAND USE ELEMENT OF THE COUNTY GENERAL
PLAN FOR THE HOPKINS AMENDMENT REQUEST (7-88-CO) AND FOR CHANGING THE COUNTY
ZONING FROM MULTIPLE FAMILY RESIDENTIAL DISTRICT (M-12) TO NEIGHBORHOOD
BUSINESS (N-B) .
WHEREAS, a request was received from Al Hopkins to amend the County
General Plan from Multiple Family Residential to Neighborhood Commercial ; and
WHEREAS, the Board of Supervisors authorized a General Plan study for the
area; and
WHEREAS, the Appian Way Group applied for the companion application to
rezone the site (#2787-RZ) from Multiple Family Residential District (M-12) to
Neighborhood Business (N-B) .
WHEREAS, it was determined that a Negative Declaration of Environmental
Significance was appropriate for these applications and such a document was
prepared and circulated according to State law, State guidelines, and County
guidelines for implementation of the California Environmental quality Act; and
WHEREAS, staff prepared a report recommending changes in the General Plan
for the area recommending a Public/Semi-Public designation and circulated it to
interested agencies, organizations,. and individuals along with a separate
report dealing with the rezoning; and
WHEREAS, a public hearing was held on October 11, 1988 and all who wished
to testify were heard, and the public hearing was closed; and
WHEREAS, the Commission was assured that a U. S. Postal Office will be
built on the site.
NOW THEREFORE BE IT RESOLVED that the Contra Costa County Planning
Commission recommends approval of a General Plan amendment from Multiple Family
Residential Low Density to Public and Semi-Public and a rezoning (#2787-RZ)
from M-12 to N-B because a post office is an appropriate use of the site; and
BE IT FURTHER RESOLVED that all written and graphic material , developed
for and pertaining to these proceedings, are made part of the record; and
BE IT FURTHER RESOLVED that the Chairman and Secretary of the Planning
Commission shall respectively sign and attest the certified copy of this
resolution and deliver the same to the Board of Supervisors, all in accordance
with the provision of the Planning Law of the State of California.

incorporating the above and aforementioned, was given by the Planning
Commission at a regular meeting on Tuesday, September 27, 1987 by the following
