Rainey, Sheriff-Coroner Contra 40 Costa DATE: December 12, 1988 County SUBJECT: AUTHORIZE SHEP,IFF=CORONER TO WORK PRISONERS ON PUBLIC PROPERTY SPECIFIC REQUEST(S) OR RECOMMENDATION(S) & BACKGROUND AND JUSTIFICATION RECOMMENDATION: Authorize the Sheriff-Coroner to work prisoners on public property pursuant to the provisions of Section 25359 of the Government Code. BACKGROUND: The Community Food Coalition, 5121 Port Chicago Highway, Concord (415) 676-7543 (Larry Sly, Executive Director) has requested the services of five or more inmates to work in their warehouse for the forseeable future. The Work Alternative Program is unable to provide this manpower throughout the week. Section 25359 of the Government Code authorizes the Board to "provide for the working of prisoners confined in the county jail under judgement of conviction of misdemeanors under the direction of a responsible person, appointed by the Sheriff, upon the public grounds, roads, streets, alleys, highways, firebreaks, fire roads, riding or hiking trails, or public buildings, or in such other places as are deemed advisable for the benefit of the -public" . FISCAL IMPACT: None at the above location. The Community Food Coalition is able, at least short- term, to provide the transportation necessary to pick up and return inmates to the Marsh Creek Detention Facility each work day.
