Report on Recycling Legislation
SUBJECT:
SPECIFIC REQUEST(S) OR RECOMMENDATION(S) & BACKGROUND AND JUSTIFICATION
RECOMMENDATION
Adopt position in support of the re-introduction of AB 3298
during the next legislative session and re-emphasize previously
adopted generic position on recycling legislation.
FINANCIAL IMPACT
None.
BACKGROUND
The Solid Waste Commission at its November 16, 1988 meeting felt
it was appropriate to recommend that the Board support the
re-introduction of AB 3298 with amendments and that the generic
position with regard to recycling legislation, adopted by the
Board on May 10, 1988, be re-emphasized as the County' s position
on recycling legislation. The Commission also felt it was
appropriate to recommend that the Board direct the solid Waste
Commission to monitor the activities of the Senate Task Force on
Waste Management and its efforts to develop compromising
legislation which will be introduced during the new session.
Listed below are the various points found to be favorable and
unfavorable in prior recycling legislation and were adopted by
the Board on May 10, 1988 as a generic position with regard to
recycling legislation.
Favorable:
Solid waste planning fees assessed to landfill operators
should be modified to allow for expenditure for solid waste
and recycling public education programs.
Options for funding, as proposed in various pieces of
legislation, that would require an assessment to the tipping
fee should be optional for local agencie

Current State law requires a mandatory recycling goal of 20
percent in all County Sold Waste Management Plans. This
goal should be supported and not changed.
Encourage and support State research and market development
for recyclable materials.
- Develop support for a comprehensive view of resource
recovery, which includes composting and waste-to-energy in
addition to recycling.
- Develop support for integration of recycling in the overall
solid waste management program for the County as included in
the County Solid Waste Management Plan.
support local determination of how to meet State mandated
goals.
Unfavorable Points:
- Oppose fees that are assessed on landfill operators, then
sent to State agencies and then returned back to local
agencies, except for fees designated for research and market
development programs.
Oppose the involvement of the State Department of
Conservation in reviewing recycling plans. Encourage the
California Waste Management Board to review County recycling
efforts as part of the review of County Solid Waste
Management Plans.
Oppose unrealistic recycling goals.
AB 3298 has been re-introduced as AB 80 by Assemblymember Killea.
This bill again re-emphasizes the need for recycling planning and
programs and provides for a requirement that a recycling plan be
developed for each county and be submitted to the Department of
Conservation, Division of Recycling for review and approval. The
inclusion of this latter requirement is identical to such a
requirement in AB 3298. This caused problems between the
California Waste Management Board and Department of Conservation
and ultimately lead to it being vetoed by the Governor last
session.
