Acknowledge receipt of. Report #3 from O'Brien-Kreitzberg and
Associates regarding the status of justice facility construction
in the County.
BACKGROUND:
This is the third monthly report on the status of construction
work on the West County Justice Center, Marsh Creek Detention
Facility and Main Detention Facility. This report identified
scheduling issues, financial status, and major areas of concern
on each project through October 31, 1988 . Additional reports
will be forwarded to the Board of Supervisors as they are
received. (See attached report)

EXECUTIVE SUMMARY
A. INTRODUCTION:
This report is subdivided into three major sections: 1) Executive Summary,
2) Detailed Schedule and Financial Information and 3) Attachments. It
describes the design and construction progress as well as Areas of Concern j
for the West County Justice Center, Marsh Creek Detention Facility and
Martinez Detention Facility achieved during the period of September 1988.

1. West County Justice Center
a. Community Participation
!ere have been no recent meetings of the West County Justice Center
Advisory Group: . The next' meeting'of the Advisory Group is scheduled
for December 7.

b. Site Acquisition
The property owner, Pinole Point Properties, is in the process- of
selling one of its parcels to United Parcel Service. The County's
consulting appraiser will investigate the details surrounding that
transaction and revise the current appraisal accordingly.

2. Marsh Creek Detention Facility
♦ Wastewater Treatment Facility
The Court's September 27 Writ of Mandate stopped construction of the
wastewater treatment facility until an environmental impact report
is prepared and approved. This action effectively stops this
project for 6 - 9 months. The Court will allow only that additional
construction required to secure the construction area and protect it
from winter rains. Other work required to maintain and protect the
existing sewer system infrastructure, septic tanks and leach fields
is not included in the scope of the court order. On October 25, the
Board of Supervisors directed the Community Development Department
to proceed with the environmental review process.

I:2. Marsh Creek Detention Facility
a. Design

♦ Master Plan..
Design Partnership submitted the draft master plan report on October
17 for County review. All review comments are due by November 22.

Modular Dormitories.
Although the overall project design approval has. been delayed by all
the reviewing agencies, the Contractor is proceeding in both the
fabrication of the modules at the factory and the site preparation
activities. Partial design review decisions are being made for
critical :path activities and as needed for the fabrication of the
modules.
b. Construction

♦ Wastewater Treatment Facility
Construction of the facility was stopped on September 27. The
Contractor demobilized and secured the site in the area of the
aeration lagoon and evaporation/percolation pond. All work was
completed on October 5.lit -

♦ Modular Dormitories
1. Site Work: The asbestos materials in buildings to be demolished
were removed on September 28 - October 3. The demolition of two
dormitories and a bath house occurred on October 7 - 14. Site
grading (cut to fill operation) began on October 17. This phase
of work is currently 10 days behind the contractor's schedule.
2. Modular Fabrication: All 60 modules have been fabricated (steel
framing). Wood framing, installation of windows, rough j
electrical, plumbing and HVAC is ongoing. Approximately 80% of
factory work is complete.
3. Martinez Detention Facility
a. Design
The Architectural Services Agreement for the Contract Documents,
Bidding and Construction Phases of the. project will be submitted to
the Board of Supervisors-for their approval in November:-�

1. West County Justice Center: ..
♦ Contract A: Oliver de Silva, Inc..
a. Storm Drain in the Park:
Problem: Pinole Point Steel Company complained that the storm
drain outlet in the Park was built too close to its road and bike
trail plus presented a potential safety hazard.
Action:. The Civil Engineer provided a revised design to extend
the storm drain. Unknown clay pipes crossing the storm drain
trench reported in the 9/25/88 report were resolved. Extension
of the pipe resumed on 10/08/88. . It .was discovered that at the
new outlet is lower than adjacent grade and caused ponding. The
Construction Manager contacted the Civil Engineer and the park to
resolve the problem.
b. Street Light Photocells:
Problem: Four (4) street lights installed along Giant Highway do
not automatically turn-off because photocells have not been
provided. The Contractor contended that the contract design does
t not indicate the circuiting for the type of photocells specified. _
Action: The Contractor has been directed to install the
photocells.

Contract B: Walsh Construction Company
a. Plumbing & Structural Conflicts' (Claim One):
Problem: Contractor claimed 24 days and $59,000 due to alleged
conflicts between the underground plumbing and structural
footings.
Action: Claim review/negotiation meetings were held between
9/21/88 to 10/25/88.
On 10/17/88, the Construction Manager offered the contractor a
lump sum settlement of $16,000 and four days. On 10/25//88, the
Contractor_ responded with a counter proposal of $40,585 and
accepted the four days in lieu of 24 days. Negotiations to
continue.
b. Schedule Delay:
Problem:•!-_-;Per:the Contractor's 10/25/88 .CPM schedule update, the
Contractor is.:14 days behind.schedule z" ::, :I�:: z., "
Action: The CM and Contractor have developed work around
solutions_s._to,::expedite the work by making block activities
concurrent rather than sequential with concrete work. It is
forecasted that the Contractor can regain lost .time. : In
addition'
a. four (4) day contract time extension is' recommended
for claim one above.
C. CPM Schedule: . . _..:
Problem: The initial CPM schedule was rejected due to
questionable activity durations, crew loading, cost loading and
logic.
Action:. No . change in status. The Contractor is to revise and
resubmit the schedule.
d. Quarry Waste-
Problem: The Architect was. concerned that the quarry waste
between the outer and inner perimeter. security fences would
gradually erode when placed on the slopes.
Action: The Construction Manager is assessing the estimated
costs of these two alternatives. To mitigate this potential -
problem, the quarry waste can be .replaced with gravel or the
quarry waste can be coated with a liquid asphalt material.

t Contract B: Walsh Construction Company(Cont'd)
e. i Electrical Room Equipment Clearances:
Problem: County code inspector stated the Contractor's intended
layout for electrical equipment in electrical rooms will not
meet clearance requirements per code. The Contractor is claiming
a delay stating that the room size as originally designed is too
small.

Action: CM, AE and the electrical subcontractor are expediting
the reconfiguration of the electrical equipment layout to meet
the code requirement.
f. Proposed Gasline Material Substitution:
Problem: Contractor proposed to substitute`-the specified steel
pipes with "orange plastic pipes" for the gasline.

Action:. The proposed substitution was technically approved=by the
design engineer. The Contractor initially offered a credit of
($2,324). The offer was considered inadequate and the Contractor
ff was`:instructed :to use'.the steel pipe system.
g. i Fire Riser Room:
Problem:_ The Contractor claims that the Fire Riser equipment
will not fit in the allotted space and will •block the' .access
doors.
Action: The Architect requested a submittal of all equipment and
a layout from the Contractor.
h. Interior Design Changes:
Problem: The interior designer and County are making changes to
the communication and electrical outlets due to program changes.
Action: The interior designer and County have been put on notice
that only essential changes should be considered since the
Contractor is in the process of pouring slabs. To expedite the
work, time-and-material-changes have been issued for changes
received to date.

4 2. Marsh Creek Detention Facility:
♦ Modular Dormitories
a. � Design Approval:
Problem: Design approvals are behind schedule and may impact
construction due to incomplete submittals, the adequacy of
existing utilities and reviewing agencies manpower shortages.
The Contractor is concerned that approval delays will impact his
construction schedule.
Action: The Contractor and Construction Manager have identified
and resolved design questions impacting critical path activities
and direction has been given which eliminates construction
delays. The State Fire Marshal approved drawings on October 12.
All Board of Corrections questions are program related and do not
affect..construction.. ..The PM issued..a,unilateral.,_design. approval
for site grading which includes work not originally planned by
the Contractor.
♦ Waste-dater Treatment Facility
a. Work Stoppage:
Problem: The Court's: decision stopping , construction of the
wastewater treatment• facility pending compliance with the
California.Environmental..Quality Act ,requires_on-going. use of the
facility's failing leach field.
Action: The County's design engineer and project team reviewed
various actions to improve the existing system and mitigate the
potential for its failure. The General Services Department has
made arrangements to remove built-up sludge and scum from the two
septic tanks, to hydro flush and chemically treat both leach
fields, and treat the septic tanks to increase anaerobic
,f bacterial action. The Sheriff's Department has stepped up water
conservation resulting in a significant reduction in use. The
Contractor originally constructing the wastewater treatment
facility is remobilizing to upgrade the existing sewer pipes,
install temporary sewage holding tanks, and grade hillside storm
runoff away from the leach fields. Construction will begin the
first week of November.

SCHEDULE ANALYSIS
1. GENERAL:
The detailed schedule report is subdivided by three projects: 1) West
County Justice Center, 2) Marsh Creek Detention Facility and 3) Martinez
Detention Facility. The three projects are further divided into the design
and construction phases. The design portion will include general design
data and a progress narrative. The construction section will be subdivided
by each contract and will provide contract data, a progress narrative, plus
a bar chart.
2. West County Justice Center
a. Design:
The' furnishing, equipment and signage phase of design remains on
schedule. Progress review meetings were held on October 6 and 20.
The preliminary design phase presentation is scheduled for November 2.
b. •Constiruction:
The West County Justice Center project includes two contracts:
1) The first contract was for the rough grading of the project
site (Contract A), which is substantially complete.
2) The second is for the construction of the detention facility
(Contract B).

B. PROGRESS NARRATIVE
1. Building One (Administration Building): Underfooting electrical
conduit installation was close to 100% complete. Underslab electrical
installation started at the west side and was about 40% complete.
Underground plumbing installation was approximately 95% complete.
Foundation footing construction was 909 complete at the west side and
40% complete at the east side. The first two courses of concrete
blocks at the west side were 759 complete. Hollow metal door frames
(non-detention type) for Building No.l were delivered to the jobsite.
According to the Contractor's CPM progress schedule update, the
project critical path still goes through Building No. 1. While a four

(4) calendar day delay has been assessed against the underground
plumbing%structural conflicts, additional slippage in the critical path is
observed for Building No. 1 due to the Contractor's own unsatisfactory
progress. According to the Contractor, the schedule logic for the concrete
block work will be revised to regain the lost time.
2. Building Two (Medical/Dental/Library/Classroom Building): Foundation
footing construction was complete.
3. Building Three (Multi-purpose Building): No progress.
4. Building Four (Inmate Housing/Central Visiting): Foundation footing
construction and underslab plumbing were practically complete. First 2
courses ,'of concrete blocks were 1007 completed. Under-footing and
underslab electrical work was 1007 complete. Slabs-on-grade were poured ,
except for south end where it connects to the tunnel.
5. Building ; Fiver (Inmate Housing)-'' Foundation `footing construction= was
complete ,except� for, the Core Area.` Underslab plumbing was 987 complete.
Underslab electrical installation was - 607 complete: First 2:"courses of
blocks were 1007 'complete.
6. Building Six (Inmate Housing): Foundation footing construction was
complete!except. for:-the Core Area. Underslab plumbing. was 987 complete.
Underslab electrical installation was -407 complete. First 2 courses of
blocks were 987 complete.
7. Building Seven (Inmate Housing): Foundation footing construction was
complete except for the Core Area. Underslab plumbing was 987 complete.
Underslab electrical installation about to start. First 2 courses of
blocks were 907 complete.
8. Building Eight (Inmate Housing): Foundation footing construction was
complete except for the Core Area. Underslab plumbing was 987 complete.
Underslab electrical installation was 807 complete. First 2 courses of
blocks were 1007 complete.
9. Site Utilities: Storm drain system was approximately 937 complete.
Sanitary sewer system was approximately 957 complete. Site water line was
approximately 957 complete. No progress on site gas, line system. Site
underground electrical installation was approximately 957 complete. Site
communication underground conduit installation was approximately 65% _
complete.
10. Site Work: Phase 1 security fence pole installation was about 1007
complete ,at the north and west sides and 909 complete at the east side.
Interior road base was 757 complete. Construction of the first 2 bays of
the parking lot was about 307 complete. Placement of topsoil around the

3. Marsh Creek Detention Facility
a. Design
♦ Modular Dormitories
The Contractor's schedule called for all review comments by September 26
with drawing revisions to be completed by October 3. The preliminary
reviews were forwarded by the following reviewers:
State Fire Marshall September 20
Board of Corrections September 23
Building Inspection Department October 18
Project Manager (Civil Drawings) September 23
Eastern Fire District October 4
All review comments required additional information or revised designs
which is delaying the final design approval. The final approval for the
critical path activity (site grading) was issued by the Construction
Manager. on;..October 25, 8 days after the beginning of this activity. This
approval:was delayed due to a difference over the design of the "keyway" at
the base of fill area and the requirement for a subsurface drain. To date,
none of the reviewing ,agencies have issued final project design approval.
The site work does not require a building permit. This work is receiving
full time monitoring by the County's Consulting Geotechnical Engineer.
♦ Wastewater Treatment Facility
John Carollo Engineers'.- scope: of work was expanded..to include design of a
sewer lateral and fire main to -the new dormitories and mitigation measures
required to , keep the existing system (septic tanks- and leach fields)
operational through another winter. The construction contractor will
proceed with these projects in November.
b. Construction
Currently the Marsh Creek Detention Facility program includes two contracts
for the construction and installation of the modular dormitories and the

modules except in the 12' x 24' modules. Rough plumbing, electrical,
heating and ventilation were approximately 15% complete. Wall
"= insulation was approximately 80% complete. All totalled, the modules
were approximately 80% complete. This work is progressing ahead of

2. On-site, asbestos abatement was 100% complete in early October.
Demolition of existing buildings and structures was complete; however,
all demolished material was stockpiled on the west-end of the
detention facility and will be removed at a later time. The grading.
was !10% complete, with the entire site cleaned and grubbed and the
keyway for the fill slope cut. The consulting soils engineer, after
inspecting the site and reviewing the revised site plan, recommends a
sub-,surface drain be installed in the keyway. Additionally, the
grading of the fill slope was 1 1/2 weeks behind schedule, which is on
the project critical path.
