Bragdon ^"�"r,'�tra Director of Community Development Costa DATE: January 17, 1989 Coity SUBJECT: Hearing on Rezoning Application #2808-RZ, to rezone 10. 542 acres of land from Heavy Agricultural District (A-3 ) to General Agricultural District (A-2) , described as Parcel A of MS 33-85, located at #155 ' Eagle Lane, in the Knightsen area, filed by Larry and Sandra Wilgenbush (Applicants & Owners) . SPECIFIC REQUEST S) OR RECOMMENDATIONS(S) & BACKGROUND AND JUSTIFICATION RECOMIENDATIONS 1. Accept the environmental documentation prepared for this project as being adequate. 2. Approve the Rezoning Application #2808-RZ as recommended by the East County Regional Planning Commission. 3. Adopt the East County Regional Planning Commission's findings as set forth in Resolution No. 1-1989 as the determination for these actions. 4. Introduce the ordinance giving effect to the aforesaid rezoning, waive reading and set forth date for adoption of same. CONTINUED ON ATTACHMENT: YES SIGNATURE- RECOMMENDATION OF COUNTY ADMINISTRATOR RECOMMENDA OF-110ARP COMMTTEE APPROVE OTHER SIGNATURE(S) : ACTION OF BOARD ON February 14, 1989 APPROVED AS RECOMlEMED x OTHER This being the time heretofore noticed by the Clerk of the Board of Supervisors for hearing on the above matter, Jean Mesick, Community Development Department, presented the staff report to the Board. She also advised the Board and the applicant that prior to the filing of a map on this parcel, should the rezoning be approved, the applicant would have to demonstrate the ability to collect and convey storm water. The following persons appeared to speak on the request: Larry Wilgenbush, 155 Eagle Lane, Brentwood, applicant and owner, commented on the reasons for the requested change in zoning including his inability to grow crops on the ten acres, the dropping water table, and the ability to sell off five acres of the land. John Mass, P.O. Box E, Knightsen, Knightsen Community Council, spoke in favor of the rezoning request. The public hearing was closed. At the request of Supervisor Torlakson, Jean Mesick, again clarified that the applicant should be aware that even if the rezoning were approved, the collect and convey conditions applying to a parcel map or tentative subdivision map on this site would still have to be met. Supervisor Torlakson commented on the possibility of several property owners in the area doing collect and convey together. IT IS BY THE BOARD ORDERED that recommendations 1, 2, 3, and 4 , are APPROVED; and as in recommendation 4, Ordinance No. 89-14 is INTRODUCED, reading waived and February 28, 1989 is set for adoption of same.
