Acknowledge receipt of Report #2 from O'Brien-Kreitzberg and
Associates regarding the status of justice facility construction
in the County.
BACKGROUND:
O'Brien-Kreitzberg has been providing the Board of Supervisors
with regular reports on the status of the West County Justice
Center. They have now combined this series of reports with the
Marsh Creek Detention Center and Main Detention Center so the
Board of Supervisors has a comprehensive view of the status of
all work on the County' s detention centers. (See attached
report. ) We will continue to provide these reports to the Board
on a monthly basis.

EXECUTIVE SUMMARY ,
A. INTRODUCTION:
This report is subdivided into three major sections: 1) Executive Summary,
2) Detailed Schedule and Financial Information and 3) Attachments. It
describes the design and construction progress as well as Areas of Concern
for the West County Justice Center, Marsh Creek Detention Facility and
Martinez Detention Facility achieved during the period of September 1988.
B. GENERAL:
1. West County Justice Center
a. Furnishings, Equipment and Signage:
The Architect conducted five workshops for the facility users to
review furnishings, equipment and signage requirements.
b. Community Participation.
There have been no recent meetings of the West County Justice Center
Advisory Group. The Employment and Training Committee met September
21.
C. Site Acquisition
There is. no scheduled activity associated with the eminent domain
lawsuit. The County's special counsel filed an At-Issue Memo on
September 6, requesting a mandatory settlement conference to be held
in January 1989.

2. Marsh Creek Detention Facility
• Wastewater Treatment Facility
The wastewater treatment facility project was not publicly announced
during design thus resulting in community surprise and protest once
construction began. As a result of the community outcry, the
Sheriff's Department and Supervisor Torlakson each conducted a
public information meeting at the Marsh Creek Detention Facility.
These meetings did not result in a compromise recommended by some
members of the community, who subsequently filed a lawsuit in
Superior Court on September 15. Work was temporarily halted, and on
September 27 the Court ruled that construction of a wastewater
treatment facility could not proceed until the County complied with
the California Environmental Quality Act.

2. Marsh Creek Detention Facility
a. Design
♦ Master Plan
Design Partnership is preparing a Master Plan for the rehabilitation
of the Marsh Creek Detention Facility.
The draft master plan report is due mid-October for review. The
final report to be completed in December will prioritize and
describe each proposed project.
♦ Modular Dormitories
The Contractor's schedule called for all review comments by
September 26 with revised drawings to be completed by October 3.
The County's Building Department and the Board of Corrections did
not submit their comments within the scheduled period. The
Contractor is working directly with the State Fire Marshal's office.
b. Construction
♦ Wastewater Treatment Facility
Work was stopped on September 27. Due to the lawsuit, the
Contractor is limited to activities required to secure the site and
prepare it for the winter rain.

E. MAJOR AREAS OF CONCERN:
1. Test County Justice Center:
♦ Contract A: Oliver de Silva, Inc.
d
a. Turns at Private Road
Problem: Pinole Point Steel Company complained that the turns
for the private road were causing a potential traffic hazard.
Action: The Civil Engineer provided a revised design to widen
the paved shoulder area. By September 9, 1988, the work was
essentially completed.
b. Storm Drain in the Park:
Problem: Point Pinole Regional Park complained that the storm
drain outlet in the Park was built too close to roads and bike
trails, thus presenting a potential safety hazard.
Action: The Civil Engineer provided a revised design to extend
the storm drain. When the contractor started the extension on
September 24, two unknown sewer pipes were found crossing the
trench in the way of the storm drain. Work came to a stop
pending clarification from the park.

Contract B: Walsh Construction Company
a. Alleged Delay Due to Plumbing & Structural Conflicts:
Problem: Contractor claimed 24 days and $59,000 due to alleged
conflicts between the underground plumbing and structural
footings.
Action: The Construction Manager developed an independent
schedule analysis. The contractor provided a revised claim which
is split in two parts for detailing costs and field costs. The
detailing claim was reviewed at a meeting September 21, with the
contractor. A meeting is scheduled for next month to review the
field costs.
b. Unforeseen Soil Condition:
Problem: An unforeseen soil condition was found under Buildings
5, 7and 8.
Action: The structural engineer redesigned the slab reinforcing
per the soil engineer's recommendation. The contractor has been
requested to provide change order pricing.
C. County Code Inspections:
Problem: The timing of the County Code Inspections is critical
to the successful completion of the fast track project.
Inspection cannot be accomplished as a standard commercial
project for two reasons: (1) the County has exposure for any
alleged delay caused by its inspectors as opposed to a commercial
project and (2) the aggressive construction schedule of 21 months
to alleviate jail over=crowding must be maintained. Therefore,
extraordinary measures must be taken by all concerned including
the County Code Inspector to reduce exposure and to maintain the
schedule.
Action: A meeting was held with the code inspectors to establish
procedures to help expedite and to reduce potential claims.
d. Fence. Post Construction:
Problem: The code inspector interpreted a requirement for a
three inch clearance between the reinforcing and excavation. He
required the contractor to use spacer blocks to establish the
required clearance.
Action: It was determined by the structural engineer that the
code allows a 21 inch space which was being provided by the
contractor and that the contractor may use temporary spacers in
lieu of setting all reinforcing on permanent spacers.

Contract B: Walsh Construction Company(Cont'd)
e. Change Order Pricing:
Problem: The contractor continues to fall behind in his
notification and pricing as required by the contract. This does
not allow the County the required time to consider all options
regarding changes.
Action: The contractor was directed to provide notices and
pricing or waive their rights to the changes.
f. Schedule Delay:
Problem: As noted above, the contractor is 4 days behind
schedule.
Action: The CM and Contractor have developed work-around
solutions to expedite the work by making block activities
concurrent rather than sequential with concrete work. It is
forecasted that the Contractor can regain lost time.
g. Fire Marshal Changes:
Problem: The State Fire Marshal made changes to the drawings
after approval.
Action: Contractor was issued a proposed change to provide
pricing.
h. Topsoil:
Problem: The Architect questioned the type of soil existing in
the stockpile designated topsoil and the type of admixture.
Action: The CM instructed the Contractor to test soil.
i. CPM Schedule•
Problem: The initial CPM schedule was rejected due to
questionable activity durations, crew loading, cost loading and
logic.
Action: The Contractor is to revise and resubmit the schedule.
In addition, a series of meetings are being held to review the
subcontractors schedules and crew loading. We have found that
the contractor's CPM does not represent the subcontractor's
schedule.
j . Design Change Orders:
Problem: A series of user workshops to develop furniture and
equipment layout plans identified a number of construction
changes, i.e. , the addition or relocation of . electric and
communications outlets, relocation of doors and light fixtures,
cabinetry modifications, etc. These changes will increase
construction costs and have potential for construction delay.

Action: Each requested or identified change was reviewed for
operational necessity, resulting in some changes not being
accepted. Of the accepted changes, those affecting critical path
construction activities were handled on a fast track basis. The
balance of the change order work will be processed as the
Architect is able to prepare the necessary design documents.
These changes should have a minimal impact on the schedule.
2. Marsh Creek Detention Facility:
♦ Modular Dormitories
a. Facility Utilities:
Problem: The MCDF infrastructure (gas, electric, sewer, water)
is not well documented, under-sized and limited in distribution.
This system needs to be upgraded before service to the dorms can
be provided.
Action: The contractor's plans call for the connection to
existing utilities not yet in place. Concurrent with the design
phase of this project, the facility's existing utilities were
documented. John Carollo Engineers will design modifications to
provide a sewer connection and a new water main for fire
protection ( both fire sprinkler 'and hydrants). PG&E will
install a new electric transformer and service. The contractor
will be issued a change order to install a new propane storage
tank, modify the alignment of the sewer and electrical
connections, and install a new water main.
b. Design Review:
Problem: . The product submittals generally occur during the
construction phase of a project; however, since this is a
design-build project, the contractor has scheduled processing
submittals concurrent with the design review and revision phase
of work.
Action: Although this review process presents some risks and may
require some resubmittals caused by design changes, we have
agreed to concurrent review in order to achieve an accelerated
project schedule. To date, submittal approvals have been timely
to the construction activities.
♦ Wastewater Treatment Facility
a. Work Stoppage:
Problem: The Court ordered that the County cannot proceed with
the wastewater treatment facility until it complies with the
California Environmental Quality Act. This requirement will
delay completion of the contract 8 to 12 months, and will result
in the ongoing use of the facility's failing leach fields.

Action: The County's design engineer will modify the existing
plans to allow installation of planned sewer lines unrelated to
the proposed wastewater treatment plant. In addition, other
alternative maintenance and conservation actions are being
planned to mitigate the system potential for failure. This
emergency work will be done on a time and material basis.
3. Martinez Detention Facility:
a. Operational Impact of Construction:
Problem: The MDF is significantly crowded, a condition which
impacts any construction within inmate areas. Where possible,
areas should be cleared for construction activities and storage
of equipment and materials.
Action: The relocation of approximately 200 inmates to the Marsh
Creek Detention Facility will improve the opportunity for staged
construction activities in areas free of inmates. The architect
will be required to include special staging requirements as part
of the construction contract's general requirements. The
construction period was originally planned to begin in late 1988
but has been postponed until after the Marsh Creek population
expansion occurs. If the delay in constructing a new wastewater
treatment facility delays planned inmate expansion at Marsh
Creek, the MDF construction may occur in inmate occupied areas.

SCHEDULE ANALYSIS
A. GENERAL:
The detailed schedule report is subdivided by three projects: 1) West
County Justice Center, 2) Marsh Creek Detention Facility and 3) Martinez
Detention Facility. The three projects are further divided into the design
and construction phases. The Design portion will include general design
data and a progress narrative. The Construction section will be subdivided
by each contract and will provide contract data, a progress narrative, plus
a bar chart.
1. West County Justice Center
a. Design:
The furnishing, equipment and signage phase of design remains on
schedule. Design workshops were held with County personnel on
September 15, 16 and 20. A progress review meeting is scheduled
on October 6.
b. Construction:
The West County Justice Center project includes two contracts:
1) The first contract was for the rough grading of the project
site (Contract A), which is substantially complete.
2) The second is for the construction of the detention facility
(Contract B).

1. Building One (Administration Building) - Underfooting electrical
conduit installation was .close to 1007 complete. Underground plumbing
installation was approximately 807 complete. Foundation construction
and the first two courses of concrete blocks, both started at the west
side of Building No. 1. According to the Contractor's CPM original
progress schedule update, the project critical path still goes. through
Building No. 1; however, the delay caused by underground
plumbing/structural conflicts has been decreased from 18 calendar days
to 4 calendar days.

construction and underslab plumbing were close to 1007 complete.
First 2 courses of concrete blocks were 907 completed. Under-footing
electrical work was about 457 complete.
5. Building Five (Inmate Housing): Foundation footing construction was
25% complete. Underslab plumbing was 987 complete.
6. Building Six (Inmate Housing): Foundation footing construction was
707 complete. Underslab plumbing was 407 complete.
7. Building Seven (Inmate Housing): Foundation footing construction was
707 complete. Underslab plumbing was 407 complete.
8. Building Eight (Inmate Housing): Underground plumbing materials
delivered. Foundation footing construction was 707 complete.
Underslab plumbing was 907 complete. Electrical/communication
conduits through the first 2 courses were 957 complete.
9. Site Utilities: Storm drain system was approximately 937 complete.
Sanitary sewer system was approximately 927 complete. Site water line
was approximately 807 complete. No progress on site gas line system.
Site underground electrical installation was approximately 777
complete. Site communication underground conduit installation just
started.
10. Site Work: Phase 1 security fence pole installation was about 367
complete.

2. Marsh Creek Detention Facility
a. Design
♦ Modular Dormitories
This project was bid as a design-build project using performance
specifications and Design Development phase drawings. The contractor
submitted a set of construction documents on August 23. These documents
were distributed to the State Fire Marshal, California Board of
Corrections, the Eastern Fire District and the County's Building Inspection
Department for their review and approval. Review comments were due
September 23, however, only the State Fire Marshal and Eastern Fire
District had responded by that date. The Construction Manager rejected the
civil drawings as being incomplete.
♦ Wastewater Treatment Facility
John Carollo Engineers' scope of work was expanded to include design of a

The 1007 complete plans and specifications were issued to the contractor on
September 5. The contractor had to grade both the aerated lagoon and
percolation pond site simultaneously. Therefore; the grading of the
aerated lagoon is approximately 257 complete and the grading of the
percolation ponds is approximately 107 complete. A peremptory writ of
mandate was filed on September 16 and a Temporary Restraining Order took
effect on September 19. The barring of construction of an above ground
wastewater treatment facility caused the project to delay 6 calendar days.
A hearing is scheduled for September 27, at which time major milestone
delays will be evaluated.

3. Martinez Detention Facility
a. Design I
The Architect's fee proposal for providing Construction Documents, Bidding
and Construction phase services was sent to the County on August 11, 1988.
Additional supporting information is being provided as a result of
discussions between the Project Manager and Architect. A draft
Architectural Agreement will be drafted in the coming month with work
scheduled to begin on the Construction Documents phase in November or
December.

3. Marsh Creek Detention Facility
a. Design:
In 1985/86/87, the General Services Department spent approximately
$1,146,900 for the design, management and construction of a 120-bed modular
dormitory. Although begun before the current master planning and
development activities, the Board of Corrections staff has determined that
this project is eligible for Proposition 52 funding.
An additional $338,900 has been encumbered since 1987 for the planning,
design and management of the various projects at the MCDF. To date,
$164,065 of this encumbrance has been paid to the professional consultants.
b. Construction:
The Marsh Creek Detention Facility financial report includes two contracts:.
1) The first contract is for the design, fabrication and installation of
two 120-bed modular dormitories. The contract award was $2,449,000 of
which $116,619 is a supplemental work allowance for change orders.
2) The second contract is for the construction of a Wastewater Treatment
Facility. This work is being executed on a time and materials basis
with a contract limit of $735,000.
