SUBJECT: Code Enforcement in Canyon Area
SPECIFIC REQUEST(S) OR RECOMMENDATION(S) & BACKGROUND AND JUSTIFICATION
I . RECOMMENDED ACTIONS: Authorize and direct the County Counsel,
Community Development Department, Building Inspection Department and
Health Services Department to commence a code enforcement program in the
Canyon area, as indicated in Part III below. Authorize the County
Counsel to file appropriate civil actions to stop County code violations
in the Canyon area, subject to availability of staff and with priority
given to the most intense violations . Direct all involved County
Departments (Community Development, Building Inspection, Health
Services, etc. ) to provide any assistance to County Counsel necessary to
execute this code enforcement program.
II . FISCAL IMPACT: No direct cost; possible consequential
litigation costs .
III . BACKGROUND/REASONS FOR RECOMMENDATION: In recent months,
County Departments have received complaints of zoning, building, health,
and grading violations in the Canyon area.
These allegations appear to have merit. Residential structures,
including apartment houses, have been built in the Canyon area without
approval of the County planning agency, Building Inspection Department
or other County agencies.
Multiple housing structures have been built in areas zoned for single
family residential housing. Necessary building permits have not been
obtained from the Building Inspection Department and other County
agencies. Reports of health hazards in the water supply system and
sewage disposal systems have been reported in this area.
To the extent staff is available, priority in code enforcement
should be given first to abating the most intense parcel zoning and
building code violations . An effective code enforcement program will
require County Counsel to initiate appropriate civil actions, including
suits for injunctive relief, abatement actions, and other civil
remedies, to stop County code violations from occurring on Canyon
parcels when staff is available and in the priority of violation. All.
involved County departments, including Community Development, Building
Inspection, Health Services and Public Works, will be required to
provide any assistance necessary in order to execute this program with
available staff.

IV. CONSEQUENCES OF NEGATIVE ACTION: Without a code enforcement
program, the described violations are likely to continue to exist and
occur in the Canyon area.
