BOARD OF SUPERVISORS, COUNTY OF CONTRA COSTA
Adopted this Order on December 19, 1989 by the following vote:
AYES: Supervisors Schroder, McPeak and Torlakson
NOES: None
ABSENT: Supervisors Powers and Fanden
ABSTAIN: None
SUBJECT: Hearing On Referral By Planning Commission On Request For
Approval of Tentative Map For Subdivision 7307, in
the Walnut Creek Area.
This is the time heretofore noticed by the Clerk of the Board of
Supervisors for hearing on a referral by the Contra Costa County
Planning Commission of the request for approval of Subdivision 7307,
by Sun Capitol Properties, Inc. , applicant and owner, to divide 9
acres into 16. 1ots in a Single Family Residential District (R-6) in
the Walnut Creek area.
Mary Fleming, Community Development Department, presented the
staff report on the request before the Board, described the site,
commented on the consistency with the General Plan, and she presented
a brief history .of the proposed project. She commented that the
Planning Commission had been unable to reach a decision on the matter
and had referred the proposal to the Board of Supervisors for
decision. Ms. Fleming also advised of the staff recommendation to
approve the tentative subdivision map as submitted for the 16 lots and
to certify the environmental impact report as being adequate.
Supervisor Schroder requested clarification on the history of the
number of lots being requested.
Ms. Fleming responded to Supervisor Schroder' s request.
The public hearing was opened and the following persons appeared
to speak:
Clancy Becker, 165 Lennon Lane, #101, Walnut Creek, applicant,
requested clarification on two conditions, commented on issues
including traffic impacts, access, drainage, geology/seismicity, open
space/visual impacts, and grading and he requested approval of the
project.
Susan. Rothenberg, 3216 Ronino Way, Lafayette, spoke in support of
the project.
Richard Engelhardt, 25 Tyson Court, San Ramon, spoke in support
of the project.
Owen Poole, 151 Spyrock Court, Walnut Creek, spoke in support of
the project.
David Heaton, 1672 Poplar Drive, Walnut Creek, spoke in support
of the project.
Terry Macken, 2032 Vanderslice Avenue, Walnut Creek, spoke in
favor of the proposed project.
Cheryl Kondrat, Walnut Creek, spoke in opposition to the project.
Supervisor Fanden excused herself from the meeting due to a prior
commitment.
Craig Dorman, 8 Arbutus Court, Walnut Creek, spoke in opposition
to the proposed project.
Harry Touros, 16 Lee Street, Walnut Creek, spoke in opposition to
the proposed project and presented a letter from neighbors, Richard
Fromberg and Kathleen Treleven in opposition. '
George Hoar, 175 Arlene Drive, Walnut Creek, spoke in opposition
to the project.
Bonnie Sankey, 1661 Arbutus Drive, Walnut Creek, spoke in
opposition to the project.
Stephen Sankey, 1661 Arbutus Drive, Walnut Creek, spoke in
opposition to the project.
Barry Stratton, 121 Twin Peaks Drive, Walnut Creek, spoke in
opposition to the project.

The public hearing was closed.
Supervisor McPeak suggested scheduling a time .for decision on
this matter when there would be at least four members of the Board
present and she questioned County Counsel. as to whether this matter
could be deferred for decision to the December 21, 1989 meeting.
Supervisor Schroder agreed with Supervisor McPeak' s suggestion
indicating that Supervisor Fanden would be present and this would also
give Supervisor Schroder an opportunity to confer with the Public
Works Department relative to questions on the geology of the area and
the intersection at Arbutus and Twin Peaks. Supervisor Schroder moved
to defer the decision on the above matter to December 21, 1989 at 4:00
p.m.
IT IS BY THE BOARD ORDERED that the decision on this matter is
DEFERRED to December 21, 1989 at 4: 00 p.m.
