HomeMy WebLinkAboutMINUTES - 12191989 - T.5 T. 5 THE BOARD OF SUPERVISORS OF CONTRA COSTA COUNTY, CALIFORNIA Adopted this Order on December 19, 1989 by the following vote: AYES: Supervisors Fanden, Schroder, McPeak and Torlakson NOES: None ABSENT: Supervisor Powers ABSTAIN: None --------------------------------------------------------------------- --------------------------------------------------------------------- SUBJECT: Hearing On Proposed Amendment To The County General Plan 7-87-SR, Blackhills Developers, Danville Area. This is the time heretofore noticed by the Clerk of the Board of Supervisors for hearing on the recommendation of the San Ramon Valley Regional Planning Commission on a request by Blackhills Developers to amend the County General Plan for approximately 300 acres located between the Blackhawk Ranch development and Mt. Diablo State Park. The request includes gifting 210 acres to Mt. Diablo State Park and changing the County General Plan from Open Space to Parks and Recreation, Single Family Residential Low Density and Open Space, and would allow for up to forty homes to be built on the site (County File 47-87-SR) in the Danville area. Jim Cutler, Community Development Department, presented the staff report on the requested amendment, describing the site, the recommendation of the Planning Commission, the rare and endangered species, and the recommendation for a reduction to 37 lots. Supervisor Schroder requested clarification from staff on the access to the proposed project and the construction access. Mr. Cutler responded to Supervisor Schroder' s request commenting on the access. The public hearing was opened and the following persons appeared to speak: Sanford Skaggs, P.O. Box V, Walnut Creek, attorney representing the applicant, commented on issues including a brief history of the proposal site, the access, traffic, dedication of about 70 percent of the property to the public, consistency with the Blackhawk Development, density, and he requested changes in the special considerations relative to the restoration of the number of lots to 40 , elimination of the additional whipsnake study and elimination of the requirement for an on-site recreational facility. Mr. Skaggs requested that the Board vote in favor of the General Plan Amendment today. Supervisor McPeak requested clarification on whether or not the applicant would take advantage of the policy for voluntary contributions to the homeless. Mr. Skaggs advised that he would respond to Supervisor McPeak' s request after conferring with the applicant.' Mark Armstrong, P.O. Box 218, Danville, attorney representing the Country Club At Blackhawk Association, commented on issues including the the Association' s neutral position with respect to the project itself, and the opposition of the Association Board to a public trail to the edge and through Blackhawk. Chris Valle-Riestra, 257 Vernon Street #321, Oakland, representing Save Mt. Diablo, commented on a letter dated December 17, 1989 outlining the position of Save Mt. Diablo, and he commented on major concerns including natural resources on the site, the plant and 'e ✓ animal species on the site, and the maintenance of riparian habitat along Sycamore Creek. Dennis Fitzpatrick, 2949 Deer Meadow Drive, Danville, spoke in opposition. Joe Willingham, spoke for Mr. Glenn Coppe, 6327 Ascot Drive, Oakland, representing the California Native Plant Society, commented in support of Mr. Valle-Riestra' s analysis and on the riparian habitat of Sycamore Creek. Jud Mygatt, 3057 Deer Meadow Drive, Danville, spokesperson for Residents Opposing Blackhills, spoke in opposition. Alan Waltner, 1736 Franklin Street, 8th Floor, Oakland attorney, Gorman and Waltner, representing Residents Opposing Blackhills, spoke in opposition. Nancy Tenuta, 536- Blackhawk Club Drive, Danville, spoke in opposition on issues including construction and traffic. Bruce Corn, 3053 Deer Meadow Drive, Danville, spoke in opposition. Michael B. Halloran, 3696 Silver Oak Place, Blackhawk, Danville, spoke in favor. Mary L. Bowerman, 970 Second Street, Lafayette, presented a history of the proposed site and commented on concerns including flooding, donation of the canyon proper to Mt. Diablo State Park, and plant species in the area. Mr. Skaggs spoke in rebuttal and responded to Supervisor McPeak' s earlier inquiry that the applicant supports the homeless programs of the County and would be happy to be a contributor to them. The public hearing was closed. Supervisor Schroder recommended due to the Christmas season and request from concerned people, that the decision be deferred to January 23 , 1990 with the written record left open for comment until December 31 , 1989 and he so moved. Supervisor McPeak seconded the motion. The board discussed the matter. On recommendation of Supervisor Schroder, IT IS BY THE BOARD ORDERED that decision on the General Plan Amendment request .( County File #7-87-SR) is DEFERRED to the January 23 , 1990 Determination Calendar with the record left open for written comment until December 31, 1989.
