RECONMEEMATION
Acknowledge receipt of the attached Report #14 from
O'Brien-Kreitzberg & Associates for the month of September, 1989
on the status of construction work at the County' s detention
facilities.
BACKGROUND:
The attached Report #14 outlines the status of work at the West
County Justice Center which is on schedule and within budget,
although the Construction Manager notes that the contractor may
be filing a major claim due to the County' s code interpretation
in excess of that required by the State Fire Marshal. He also
notes that an additional 10 day time extension has been
negotiated and will be recommended for County approval.
The report also outlines the status of the Marsh Creek Detention
Facility where, the contractor for the dorms corrected a drainage
problem identified by the County' s soils engineer. Miscellaneous
"punch list" work must be completed before the contract can be
closed out.
Finally, the report . outlines the status of work on the Main
Detention Facility where the Construction Manager reports that
design review backlogs with the Board of Corrections is delaying
final completion of the design contract documents. This review
is currently 30 days behind the project schedule. The

EXECUTIVE SUMMARY
A. INTRODUCTION:
This report is subdivided into three major sections: 1) Executive Brief and
Summary, 2) Detailed Schedule and Financial Information and 3) Attachments.
It describes the design and construction progress for the West County
Justice Center, Marsh Creek Detention Facility and Martinez Detention
Facility achieved during the period of September 1989 as well .as Areas of
Concern.
B. GENERAL:
1. West County Justice Center
a. Revised Environmental Impact Report
The administrative draft of the EIR is due to the County for review on
October 20.
b. WCJC Advisory Group
The Advisory Group met on September 27 -at the project site to tour the
facility. There are no issues currently pending with the group.

1. West County Justice Center
a. Design:
The 1007 complete signage contract documents are due by the end of
September. The County continues to review the 907 complete
furniture plans. A number of items require further evaluation.
b. Construction:
1) Contract A: Substantially complete.
2) Contract B: Construction contract critical activity were
construction of the remaining second floor masonry walls and the
.roof at the Administration Building and roof installation at the
Housing Buildings No. 6, 7 and 8. Schedule status was as
follows:

The 90% complete contract documents were submitted for- review on
August 18. Review sets were distributed to the Sheriff's
Department, Board of Corrections, State Fire Marshal, Building
Inspection Department and Consolidated Fire District. The review
responses remain outstanding.

E. MAJOR AREAS OF CONCERN:
1. West County Justice Center:
♦ Contract B: Walsh Construction Company
a. County Code Interpretation of Fire Ratings:
Issue: The Contractor is preparing a claim for indirect and
delay costs associated with the time required to resolve issue
and implement solutions required by the County Code inspector's
interpretation of the fire rating of the mechanical shafts in the
housing units.
Action: The Construction Manager is analyzing the schedules and
the work accomplished and will make determination when the claim
is received.
b. Termination of Kitchen Equipment Subcontractor:
Issue: The kitchen subcontractor was terminated by the
contractor for non-performance. The Contractor is negotiating
with various kitchen equipment sub-contractors as a replacement.
The project has been impacted by the lack of manpower and
- supplies for this part of the work.
Action: The Construction Manager is monitoring the affect upon
the schedule for this change of sub-contractor and has put the
Contractor on notice.
C. Security Equipment Installer:
Issue: Jensen, the security equipment installer (a
sub-contractor to Thorn Electronics) was terminated. Thorn has
selected another installer, Warner Electronics, who will start
work in early October. This has resulted in delays due to the
lack of manpower and materials.
Action: The Construction Manager is evaluating the effect of the
change upon the schedule and is evaluating alternatives to make
up the time lost. The Contractor has been put on notice.
d. Food Carts:
Issue: The Construction Manager directed the contractor to
negotiate prices for furnishing the food carts. They have prices
from two suppliers. The price for the specified cart is
$163,517, and the price for an alternate cart is $122,820.
Action: The Construction Manager will evaluate the two bids once
the Sheriff's Department has determined the lower priced cart is
operationally acceptable.

Contract B: Walsh Construction Company(Cont'd)
e. Curb Claim:
Issue: The Construction Manager issued his final decision on the
roof equipment base support claim. The Construction Manager
agreed with the Contractor that the metal stud supports were an
addition to the scope of work but requested a credit for the tee
beams that were a reduction in the Contractor's scope of work.
The Contractor is not in agreement with the credit request.
Action: The Construction Manager and Contractor will negotiate
the costs of these changes and the CM will issue a dispute
decision.
f. Deck Opening Claim:
Issue: The County issued its final decision on this dispute
denying the claim. The Contractor has filed the notice to
litigate.
Action: The Contractor may litigate after County acceptance of
the contract..
g. Toilet Accessory Claim:
Issue: The County issued its final decision on this issue
denying the claim. The Contractor has notified the Construction
Manager that it intends to litigate.
Action: The Construction Manager will maintain files supporting
the claim denial. The Contractor may litigate after County
acceptance of the contract.
h. Seamless Flooring:
Issue: The Contractor has issued a claim that the seamless
flooring was incorrectly specified as a sole source item.
Action: The Construction Manager is preparing a response.
i. Fire Damper Support:
Issue: The Fire Marshal has requested additional UL information
concerning the framing support of the fire dampers. This is
holding up drywall installation in a number of areas.
Action: The Contractor was directed to supply submittal
information.

j. Fire Safing:
Issue: The County Code Inspector questioned the type of fire
safing material required around piping and requested a UL
submittal. This is delaying piping in a number of areas.
Action: The Contractor was instructed to provide the submittal
by the Construction Manager.

SCHEDULE ANALYSIS
1. GENERAL:
The detailed schedule report is subdivided by three projects: 1) West
County Justice Center, 2) Marsh Creek Detention Facility and 3) Martinez
Detention Facility. The three projects are further divided into the design
and construction phases. The design portion will include general design
data and a progress narrative. The construction section will be subdivided
by each contract and will provide contract data, a progress narrative, plus
a bar chart.
2. West County Justice Center
a. Design:
The status for ongoing design phase is:
Equipment - Complete.
Signage - final plans and specifications due in late September
Furniture - 90% complete, County reviewing documents
- a number of items require refinement or clarification
b. Construction:
The West County Justice Center project includes two contracts:
1) The first contract was for the rough grading of the project site
(Contract A), which is substantially complete.
2) The second is for the construction of the detention facility
(Contract B).

2. PROGRESS NARRATIVE
Actual construction during September was half that scheduled. Reason for
the slow rate of construction included: lack of manpower in the crafts of
plumbers and sheet metal workers, termination of the security equipment
installer, Jensen Electric, and sequential work practices among the various
trades and in the various buildings. If these practices continue, the
completion of the project may be delayed beyond the current completion date
of May 2, 1990.

a. Building One (Administration Building): The work is behind schedule.
The current critical activity is the partition walls on the the first
floor and duct work installation on the second floor. The- partition
walls have just started and should be complete in mid-November. The
duct work installation is 60% complete and should be complete in early
October.
b. Building Two (Medical/Dental/Library/Classroom Building): The work is
on schedule. The current critical activity is the duct work which was
just started. This activity is scheduled for completion on
October 31.
C. Building Three (Multi-purpose Building): The work is on schedule.
The current critical activity is duct work which is scheduled to
finish in October.
d. Building Four (Intake Housing/Central Visiting): Ahead of schedule.
The current critical activity is duct work, which is scheduled for
completion in early November.
e. Building Five (Inmate Housing): Behind schedule. The current
critical activity is core area electrical and communication wiring and
termination. These activities are scheduled for completion in
mid-October.
f. Building Six (Inmate Housing): Behind schedule. The current critical
activity is plumbing rough-in, which is scheduled for completion in
early October.
g. Building Seven (Inmate Housing): Behind schedule. The current
critical activity is plumbing rough-in, which is scheduled for
completion in early October.
h. Building Eight (Inmate Housing): Behind schedule. The critical
activity is duct work, which is scheduled for completion in early
October.
3. PROGRESS BAR CHART:
A progress bar chart is included to this report (Attachment D). It
compares the actual physical progress of field activities to their
scheduled progress. As of the end of September, construction is about
62.9% complete compared with scheduled completion of 70.3%.

4. AREAS OF CONCERN:
a. Termination of Jensen Electric:
Issue: Jensen Electric was a third tier subcontractor to Thorn, who
is. the subcontractor for the security equipment. Due to an internal
disagreement between these two companies, Jensen Electric was
terminated. This can cause delays to the project.
Action: The Construction Manager is monitoring the schedule closely.
The Contractor has agreed to employ additional people and to work
overtime until the lost time is made up.
b. Plumbers and Sheet Metal Workers:
Issue: A shortage of plumbers and sheet metal workers is delaying
work in housing buildings 7 and 8.
Action: The Contractor is starting to work crafts concurrently. within
buildings rather than sequentially to make up the lost time. The
Construction Manager will closely monitor the schedule. If it appears
the crafts are slowing construction, the contractor has agreed to work
overtime so as not to delay the project.
C. Changes to the Jobsite Logic for Schedule:
Issue: The original jobsite logic for scheduling has been to work
individual crafts sequentially through each building. This approach
is causing slow progress.
Action: The Contractor has agreed to work his crafts concurrently
within the various buildings.

a. Construction
Currently the Marsh Creek Detention Facility program includes two contracts
for the construction and installation of the modular dormitories and the
construction of the wastewater treatment facility. Reports for each

4. Martinez Detention Facility
a. Design
The. proposed design/bidding schedule is as follows:
Design Review/estimate: August 29
Bid opening: October 31
Award: November 21
Notice to Proceed: December 4
Plans were distributed to the Board of Corrections, State Fire Marshal,
Building Inspection Department, Consolidated Fire District and Sheriff's
Department for review. These reviews will probably take 30 to 60 days given
current backlog with some of the reviewing agencies. This review delay has
impacted upon the procurement schedule. The schedule will be revised once
the Board of Corrections fire/life safety review is complete.

FINANCIAL ANALYSIS
1. General:
The detailed financial report is divided into three projects: 1) West
County Justice Center, 2) Marsh Creek Detention Facility and 3) Martinez
Detention Facility: The projects are further divided into the Design and
Construction phases. The Design portion will include a narrative. The
Construction section will be subdivided by each contract and will provide
contract data, where available, narratives and cost curves.
2. West County Justice Center
a. Design:
The Architect's basic fee is $2,494,423 of which $2,288,114 (92%) has
been paid. In addition, the Architect has been authorized $608,276 for
extra services, of which $498,440 (82%) has been paid.
b. Construction:
The West County Justice Center financial report includes two contracts:
1) The first contract was for the rough grading of the project site
(Contract "A") which is substantially complete.
The remaining contingency for Contract "A" is <$4,665>.
2) The second contract : is for the construction of the detention
facility (Contract "B").
The remaining contingency for Contract "B" is $545,676.

2. NARRATIVE:
a. The pump controls are such that in some circumstances, both pumps will
operate at the same time. The power supply designed and installed in
Phase B will only support one pump. The Engineers have verified that
only one pump. is required and the second is a backup. We have,
therefore, issued a PC requesting prices to modify the controls to
restrict operations to only one pump at a time.
b. The pumps are scheduled for shipping on October 2, 1989.

3. COST CURVES: (see attached) ,
A cost curve is attached, comparing the actual progress (cumulative actual
value of work completed and permanent materials delivered to site) as of
the report date (9/25/89) to the Contractor's forecast progress. The
Contractor's forecasts (early start forecast and late start forecast) are
based on the values assigned to individual activities in the Contractor's
12/23/88 revised baseline schedule. The actual value of base contract work
completed to date is $18,575,519; for change orders, it is $258,742. The
total value to date becomes $18,834,261. The actual amount of payment to
the Contractor is the actual value of work less retention placed in an
escrow account.

3. Marsh Creek Detention Facility
a. Construction:
The Marsh Creek Detention Facility financial report includes two contracts:
1) The first contract is for the design, fabrication and installation of
two 120-bed modular dormitories. The contract award was $2,571,450 of
which $122,450 is a supplemental work allowance for change orders.
2) The second contract is for the improvements to the wastewater
treatment system. This work was executed. on a time and materials
basis with a contract limit of $975,000.

Architect's paid total to $76,016.
The Architect's September cost estimate for construction increased to
approximately $550,000 due to scope changes during design. Providing
bidding and change order allowances, the budget for construction has been
increased from $425,000 to $633,000. This $208,000 increase is available
within the State's Proposition 52 grant due to a shift in funds of the West
County Justice Center grant for other jail construction within the County.
This reallocation of funds was authorized after the construction bid for the
West County Justice Center was lower than the budget.
