Bragdon - �ntra December 1:3 , 1989 Costa DATE: �� Amendment One to the Consultant Contract for the SUBJECT: Preparation of the Environmental Impact Report for the Marsh Canyon Sanitary Landfill Project SPECIFIC REQUEST(S) OR RECOMMENDATION(,S) & BACKGROUND AND JUSTIFICATION RECOMMENDATION Authorize the Director of Community Development to execute Amendment One to the County' s contract with the consulting firm of Environmental Science Associates, Inc. , for the preparation of the Environmental Impact Report for the proposed Marsh Canyon Sanitary Landfill project. FINANCIAL IMPACT Amendment One would provide additional funding for the costs of preparing the Draft Environmental Impact Report (public review draft) for the subject project. The cost of the additional consultant work is $98,000; the County' s 25 percent surcharge for administration is $24,500 ; bringing the total to $122,500 . The entire cost of Amendment One is borne by Waste Management of North America, Inc. BACKGROUND The Marsh Canyon Sanitary Landfill project requires an Environmental Impact Report (EIR) under the terms of the California Environmental Quality Act. On May 16 , 1989, the Board of Supervisors approved a contract with the firm of Environmental Science Associates for $199,938 for the preparation of the EIR. At the time, it was recognized that pending studies, unresolved project details, or unanticipated volumes of review comments could warrant contract revisions. Subsequently, the applicant did change details of the project in September and October, and provided study information to the consultant in that period later than originally scheduled. As a result, a major revision of the administrative draft (staff review document) of the EIR had to be prepared, and the draft EIR (public comment document) had to be readied for publication under expedited circumstances. The attached November 16, 1989 letter from the consultant shows how these changes and submittals increased the c sultant' s costs beyond those covered by the original contract. November 16, 1989 Mr. Charles Zahn Contra Costa County Community Development Department 651 Pine Street.4th Floor, North Wing Martinez, CA 94553-0095 Dear Mr. Zahn: We are pleased, as I'm sure the County is, that the Marsh Canyon Sanitary.Landfill DEIR is now, as of November 13th,published and in its public review. The scheduling information included in the attached modification to ESA's contract indicates that the Final EIR (FEIR) can be published by February 1, 1990. Completing the DEIR involved a much greater effort than was envisioned when ESA submitted the ADEIR in August. At that time, critical details involving the visual study, the water pipeline extension,and the wetlands report were still outstanding. ESA's involvement in these details,especially the water pipeline extension and the EDAW visual study, required efforts beyond the original scope. The supplemental information to the project was substantial, as you are well aware. I provided you with copies of the major post-August submissions during our meeting on October 31, 1989. These included submissions by the applicant on September 1, October 2,October 17, October 23, and October 27. The renditions of the site entrance,prepared by Ward Associates, arrived on October 27th. The total amount of this contract modification is $98,000. It includes the extra costs incurred by ESA through November 10th ($83,750),the increased cost of retaining Black & Veatch($8,250), and an increased amount of effort that we estimate will be needed by ESA to complete the FEIR ($6,000). ESA's total hour commitment for the FEIR has been raised from 130 hours to 230 hours (190 hours for revision of ADEIR (RTC) and 40 hours for miscellaneous assistance to the County). It is hoped that the comments on the document can be handled adequately with this labor commitment, so that additional contract modifications will not be necessary. Based upon the expected level of public concern for the Marsh Canyon Sanitary Landfill project,this increased 'amount of hours is more realistic than the previously budgeted amount. ESA included this additional FEIR amount in response to your authorization letter of November 1, 1989, which asked us to document the "additional costs of the Draft EIR and the remaining costs of preparing the Final EIR." The additional funds for Black & Veatch covered analysis of: the increased excavation and its use as soil cover material; the landfill development plan now proposed to be from the top of the canyon toward the bottom; additional seismicity information related to slope stability; and coordination of these analyses within the Geology, Hydrology, and Engineering Design Review sections of the DEIR.
