Spooner, Contracts AdministratorCosta DATE: December 12, 1989 County SUBJECT:Approval of Novation Contract #24-727-31 with Many Hands, Inc. for Provision of Mental Health Program Services in Fiscal Year 1989-90 and Fiscal Year 1990-91 SPECIFIC REQUEST(S) OR RECOMMENDATION(S) & BACKGROUND AND JUSTIFICATION I. RECOMMENDED ACTION: Approve and authorize the Chairman to execute on behalf of the County, Contract #24-727-31 with Many Hands, Inc. , upon approval of the contract document by the County Administrator, or his designee, in the amount of $548,532 for the two-year period from July 1, 1989 through June 30, 1991 for provision of socialization and vocational ' day treatment services for mentally handicapped clients. This contract includes a six-month automatic contract extension from June 30, 1991 through December 31, 1991 in the amount of $137, 160. II. FINANCIAL IMPACT: This Contract is funded in the Health Services Department Budget for 1989-90 (Org. #5942) by State Short-Doyle Mental Health funding and County funding, estimated as follows: $186,462 State Short-Doyle Funds 87 ,804 County Funds $274, 266 Fiscal Year Payment Limit for 1989-90 274 ,266 Fiscal Year Payment Limit for 1990-91 $548,532 TOTAL CONTRACT PAYMENT LIMIT Fiscal Year Payment Limits set forth above do not include any cost- of-living increase for Fiscal Year 1989-90 or Fiscal Year 1990-91; in the event that the Board of Supervisors authorizes a cost-of- living adjustment expressly for this contract before December 31, the Fiscal Year Payment Limits and Total Contract Payment Limit may be modified by a written Administrative Amendment executed by the Contractor and the County Administrator, or his designee, to reflect any such cost-of-living increase, except that this provision shall not be construed to require agreement to any such increase. DEPUTY Novation Contract #24-727-31 Board Order Page 2 Furthermore, the contract document includes a provision which terminates the Contract without notice for the 1990-91 Fiscal Year if the Federal, State or other non-County funding for this Contract ceases and which makes the Contract valid and enforceable only if sufficient funds are made available by the State Budget Act for Fiscal Year 1990-91 for the purposes of these Contract programs. III. REASONS FOR RECOMMENDATIONS/BACKGROUND: This Contractor has been providing these mental health program services under an automatic extension of FY 1988-89 Contract #24-727- 30. Novation Contract #24-727-31 replaces the six-month automatic extension under the prior contract. These contract services are a vital and important part of the County's continuum of care for mentally disturbed adults in the eastern area of the County. Beginning on July 1, 1989, the basis of payment for the provision of these contract services was changed from a cost reimbursement basis to fee-for-service (also called "net negotiated rate") at the rates of $54 per patient per day for vocational day treatment services and $27 per patient per day for socialization day treatment services. These rates were approved by the State Department of Mental Health for this Contractor on June 13, 1989.
