Spooner, Contracts Administrator Costa DATE: December 7, 1989 County suBJEC4pproval of Novation Contract #24-133-23 with La Cheim School, Inc. for Intensive Day Treatment Program Services for Children and Adolescents SPECIFIC REQUEST(S) OR RECOMMENDATION(S) & BACKGROUND AND JUSTIFICATION I. RECOMMENDED ACTION: Approve and authorize the Health Services Director or his designee (Stuart McCullough) to execute on behalf of the County, Novation Contract #24-133-23 with La Cheim School, Inc. , upon approval of the Contract document by the County Administrator or his designee, in the amount of $668,265 for the period July 1, 1989 through June 30, 1990 for provision of intensive day treatment services in a school setting for mentally disturbed children and adolescents. This document includes a six-month automatic contract extension from June 30, 1990 through December 31, 1990 in the amount of $334 , 132 . This contract is for a one-year period because program changes are being evaluated which will affect both treatment services and funding mechanisms and which may require significant changes in the contract in FY 1990-91. II. FINANCIAL IMPACT: This contract is funded in the Health Services Department Budget for FY 1989-90 (Org. #5952) . The Contract Payment Limit includes a $113 , 567 increase consisting of a $27, 510 shift of funding from (and corresponding decrease in) Contract #24-351-10 (La Cheim Residential Treatment Centers, Inc. ) and an $86, 057 increase in Federal Medi-Cal funding due to an expansion of Contractor's intensive day treatment program for Medi-Cal eligible clients. This increase in federal funding serves to maximize the Federal Medi-Cal revenues which are available at no additional cost to the County. This contract places the contractor at risk for serving a sufficient number of federally-eligible clients to earn the Federal Medi-Cal revenue shown below in the intensive day treatment program budget. Novation Contract #24-133-23 Board Order Page 2 The payment limit set forth above does not include any cost-of-living increase for Fiscal Year 1989-90. In the event that the Board of Supervisors authorizes a cost-of-living adjustment expressly for this contract before December 31, the fiscal year payment limit for this contract may be modified by a written Administrative Amendment executed by the contractor and the County Administrator, or his designee, to reflect any such cost-of-living increase, except that this provision shall not be construed to require agreement to any such increase. III. REASONS FOR RECOMMENDATIONS/BACKGROUND: This contractor has been providing these mental health program services under an automatic extension of the FY 1988-89 Contract #24-133-21 (as amended by Contract Amendment Agreement #24-133-22) . Novation Contract #24-133-23 replaces the six-month automatic extension under the prior contract. Approval of this contract will allow the continued provision of intensive day treatment for mentally and emotionally disturbed children and adolescents. The program maintains an ongoing census of approximately 47 youth for the County and serves approximately 60 minors per year. This contract will also provide the mental health day treatment services which are required by the Individualized Education Plans (IEPs) for some Special Education Pupils (SEP) under AB 3632 .
