Babst THE BOARD OF SUPERVISORS OF CONTRA COSTA COUNTY, CALIFORNIA Adopted this Resolution on December 19, 1989, by the following vote: AYES: Supervisors Fanden, Schroder, McPeak and Torlakson NOES: None ABSENT: Supervisor Powers ABSTAIN: None SUBJECT: Vacation of Juana Ct., Elena ) Ct., & Elena Drive ) Vacation No. 2063 ) RESOLUTION NO. 89/ 795 W.O. 1817 ) Resolution of Summary Vacation Pleasant Hill BART Station Area (S. & H. Code Section 8335) The Board of Supervisors of Contra Costa County RESOLVES THAT: This summary vacation of an excess right of way of a street or highway no longer required for street or highway purposes, is made pursuant to Division 9, Part 3, Chapter 4 of the Streets and Highways Code, commencing with Section 8330. This vacation request is for the streets Juana Ct., Elena Ct., and Elena Drive located in the Pleasant Hill BART Station area. A description of the areas to be vacated is described as follows: All of Elena Drive and Elena Court as shown on the map of Estrella Rancho filed June 7, 1953, in Book 50 of Maps at page 48; also all of Elena Drive and Juana Court as shown on the map of Estrella Rancho - Unit 2, filed March 12, 1954, in Book 53 of Maps at page 15 records of Contra Costa County, California. This vacation request is for streets that lie within the property under one ownership and that do not continue through such ownership or end touching property of another. (S. & H. Code Section 8334). This vacation request is part of a larger project for which an Environmental Impact Report was prepared, certified as complete, and findings made. The Board of Supervisors resolves that the. Final Environmental Impact Report for the Pleasant Hill BART Station Specific Plan as modified by the addendum attached hereto as Exhibit "A" is the Final Environmental Impact Report for the project. The Director of Community Development will file a Notice of Determination with the County Clerk. RESOLUTION NO. 89/ 795 ~ /, 3 3 This Board declares that the hereinabove described proposed vacation areas are HEREBY ORDERED VACATED subject to any reservation and exception described in the above legal description. From and after the date this Resolution is recorded, the streets vacated no longer constitute public highways. The Real Property Division is ORDERED to record a certified copy of this Resolution in the office of the County Recorder.
