SUBJECT: APPROVE THE AGREEMENT TO SELL A PORTION OF THE COUNTY'S
FEDERAL AID URBAN FUNDS TO THE TOWN OF DANVILLE

Justification
I . RECOMMENDATION
Approve the Agreement with the Town of Danville to sell the
County' s Pittsburg-Antioch Urbanized Area FAU (Federal Aid Urban)
funds and Authorize the Chair to execute the Agreement.
II. FINANCIAL IMPACT
The sale of funds to the Town of Danville will not affect the
County General Fund. The County will sell $500, 000 of FAU funds
to the Town and receive $400, 000 in non-federal funds. The fund
difference will be made up by 1) investing the funds to generate
interest and 2) expediting the project construction date to
reduce escalation costs.
III. REASONS' FOR RECOMMENDATION/BACKGROUND
Section 137 of the Federal Surface Transportation and Uniform
Relocation Assistance Act of 1987 (Public Law 100-17) authorized
a five year demonstration program, CRP (Combined Road Plan) , to
test the feasibility of providing block grants to states for

III. REASONS FOR RECOMMENDATION/BACKGROUND (continued)
transportation purposes. California was one of five states to
participate in the program. Effective June 1, 1989 the Federal
Highway Administration combined the funding for FAU, FAS
(Federal Aid Secondary) and non-primary HBRR (Highway Bridge
Replacement and Reconstruction) programs and required that all
funds be allocated (Projects awarded) by April 1, 1991 or lose
the funds to another jurisdiction or state.
The County has decided to sell a portion of its share of the FAU
funds to the Town of Danville and receive, at a 20% discount,
non-federal funds. The County feels that it can recoup the
discounted difference by collecting interest on the funds to be
received immediately from Danville and by being able to construct
the project in 1990. The project is currently held up waiting
for the approval of section 4 (f) statement under the Federal
Department of Transportation Act of 1966. The approval is not
expected for another year. The allocation of Federal funds for
this project becomes very uncertain.
The Urban Systems Technical Advisory Committee (City-County
Engineers) approved the sale of the funds to the Town and
recommends that the Board approve the agreement.
IV. CONSEQUENCES OF NEGATIVE ACTION
Should the Board choose not to approve the transfer of funds
there is a likelihood that the County' s Antioch-Pittsburg
Urbanized Area FAU allocation could be lost to another
jurisdiction or state.
