HomeMy WebLinkAboutMINUTES - 11071989 - 2.1 d. / THE BOARD OF SUPERVISORS OF CONTRA COSTA COUNTY, CALIFORNIA Adopted this Order on November 7 , 1989 , by the following vote: AYES: Supervisors Powers, Fanden, McPeak, Torlakson NOES: None ABSENT: Supervisor Schroder ABSTAIN: None ------------------------------------------------------------------ ------------------------------------------------------------------ SUBJECT: Acme Landfill Closure The Board received the attached report dated October 24, 1989 from Sara M. Hoffman, Solid Waste Manager, recommending approval of the Touche-Ross recommendation on allocation, collection and disbursement of costs related to the closure and post-closure of the Acme Landfill. Gary Braden of Touche-Ross reviewed the cost collection alternatives and recommended Alternative #2 , the proposed mechanism to collect the closure and post-closure costs over a 10 year period. Following discussion by Board members, IT IS ORDERED that the following actions are APPROVED: 1. ACCEPTED report from Touche-Ross and APPROVED Alternative #2 for allocation, collection and disburse- ment of costs for the closure and post-closure of Acme Landfill; 2 . DIRECTED Community Development staff to seek a variance from the Solid Waste Management Board in order to implement the procedure; 3 . REQUESTED Community Development staff and the consultants to draft a Memorandum of Understanding between the cities and the franchisers to memorialize the procedure and to assure the on-going contributions; 4. REQUESTED staff to secure an agreement with Acme Landfill to limit transfer of assets out of the company; 5. REQUESTED staff to secure an agreement with Acme Landfill to provide public benefit from the ultimate use of the land after closure; and 6. Hoffman Contra Solid Waste Manager Costa DATE: October 24, 1989 Courty SUBJECT: Closure and Post Closure Maintenance of Acme Landfill SPECIFIC REQUEST(S) OR RECOMMENDATION(S) & BACKGROUND AND JUSTIFICATION RECOMMENDATION Approve the Touche Ross recommendation on allocation, collection and disbursement of costs for the closure and postclosure of the Acme Landfill; direct Touche Ross to integrate this recommendation into the rates for the interim transfer station as appropriate; and direct the Community Development Department to submit recommendations to the California Waste Management Board on the Emergency Regulations for landfill closure and postclosure maintenance to insure conformity with Contra Costa' s allocation, collection and disbursement method for Acme Landfill. FINANCIAL IMPACT No direct financial impact to Contra Costa County. REASONS FOR RECOMMENDATIONS/BACKGROUND The Board of Supervisors authorized and directed Touche Ross to develop an allocation, collection and disbursement method to insure the proper closure and postclosure maintenance of Acme Landfill. The methodology recommended by Touche Ross was developed in cooperation with a, working committee composed of representatives from the City of Walnut Creek, City of Martinez, Central Sanitary District and the County. In addition, the report was reviewed by the Central County City Managers at a meeting held on October 27 , 1989 . The mechanism developed by Touche Ross is based on the principle of "fair share according to historic use. " Staff believes this is the most equitable way of distributing unfunded needs. Closure and postclosure funding mechanisms must be approved by the California Waste Management Board (CWMB) . On an emergency basis, the CWMB adopted regulations that provide mechanisms which are primarily applicable to landfills with a considerable remaining capacity. Final regualtions will be developed by the CWMB following public comment and a hearing on November 20, 1989 . , County Staff believes it would be appropriate to submit comments that would insure the compatibility of our closure and postclosure maintenance funding plan with these final regulations.
