U* SUBJECT: Consultant Contract to Prepare a Revised v� Environmental Impact Report for the East Contra Costa Sanitary Landfill Project SPECIFIC REQUEST(S) OR RECOMMENDATION(S) & BACKGROUND AND JUSTIFICATION RECOMMENDATION Approve and authorize the Director of Community Development to execute, on behalf of the -County, a contract with the firm , of Brady and Associates, Inc. , in the amount of $123 ,400 for the preparation of a revised Environmental Impact Report (EIR) for the East Contra Costa Sanitary Landfill project. FINANCIAL IMPACT The cost of the EIR is borne by the project sponsor, Silvio Garaventa, Sr. In addition to the consultant contract, the cost of the EIR to the project sponsor includes a 25-percent surcharge ( $30 , 850) for staff administrative services for a total of $154 , 250 . REASONS FOR RECOMMENDATION An EIR for the proposed project is required by the terms of the California Environmental Quality Act (CEQA) . BACKGROUND An EIR was completed for the East Contra Costa Sanitary Landfill project (ECCSL) in June of 1986. This EIR was approved by the County Planning Commission and is currently before the Board of Supervisors (together with the projectls Land Use Permit) for final certification. Several landmark court cases have changed what are perceived to be the standards for EIR' s since 1986 when the original EIR was prepared. 2. Important regulatory changes have occurred since 1985 when the ECCSL was first designed. 3 . Physical and planning changes have occurred in the vicinity of the ECCSL since the original EIR was prepared. The applicant wishes to have the East Contra Costa Sanitary Landfill project receive further consideration by the Board of supervisors; consequently, the applicant is willing to pay for a revised Environmental Impact Report. jl33 :eccsl.brd cc: Community Development (Orig.
