Spooner, Contracts AdministratCosta OATEt October 26, 1989 County SUBJECTI Approval for Renewal of Three Routine Drug Abuse Program 7 Novation Contracts for Fiscal Year 1989-90 and Fiscal Year 1990-91 SPECIFIC REQUEST(S) OR RECOMMENDATION(S) & BACKGROUND AND JUSTIFICATION I. RE OMMENDED ACTION: Approve and authorize the Health Services Director or his designee (Stuart McCullough) to execute on behalf of the County, three standard form Novation Contracts with Drug Abuse Program contrac- tors, as specified in the attached Contract Renewal Listing, upon approval of each contract document by the County Administrator, or his designee, for the continued provision of the same FY 1988-89 drug abuse program services for a two-year period from July 1, 1989 through June 30, 1991. These contracts include a standard provision for a six-month automatic contract extension from June 30, 1991 through December 31, 1991, as set forth in the attached Contract Renewal Listing. These Novation Contracts are for a two-year term in accordance with the policy of the Board of Supervisors es- tablished June 27, 1989 for Contracts with nonprofit agencies. II. FINANCIAL IMPACT: These contracts are funded in the Health Services Department Budget for Fiscal Year 1989-90 (Org. #5936) and are financed by the same general levels of State Drug Abuse Program Funds and County Funds. The two Fiscal Year Payment Limits set forth in the attached Contract Renewal Listing do not include any cost-of-living increases for Fiscal Year 1989-90 or Fiscal Year 1990-91; in the event that the Board of Supervisors authorizes a cost-of-living adjustment expressly for these contracts before December 31, the Fiscal Year Payment Limits and Total Contract Payment Limit for each Contract may be modified by a written Administrative Amendment executed by each Contractor and the County Administrator, or his designee, to reflect any such cost-of-living increase, except that this provision shall not be construed to require agreement to any such increase. Furthermore, the contract documents include a provision which terminates each Contract without notice for the 1990-91 Fiscal Year if the Federal, State or other non-County funding for each Contract ceases and which makes each Contract valid and enforceable only if sufficient funds are made available by the State Budget Act for Fiscal Year 1990-91 for the purposes of each Contract program. REASONS FOR RECOMMENDATIONSfBACKGROUND: These contractors have been operating these same contract programs for the County continuously for many years and they continue to provide these services for persons with problems of drug dependency and drug abuse, including such target populations as youth and the schools. These drug abuse program services continue to be a vital and important part of the County's continuum of care for County residents with drug related problems, including support for their families. These three contracts provide a range of service programs, including community drug abuse prevention, intervention, and treatment services in the northwest, Pittsburg, Antioch, and far eastern areas of the County. These Contractors have been providing these drug abuse program services under an automatic extension of the FY 1988-89 Contracts. The recommended Novation Contracts identified in the attached Contract Renewal Listing replace the six-month automatic extension under the prior contracts.
