THE BOARD OF SUPERVISORS OF CONTRA COSTA COUNTY, CALIFORNIA T. 5
Adopted this Order on November 29, 1988 by the following vote:

SUBJECT: Hearing on General Plan Amendment Request 4-86-CO,
Rezoning Request 2799-RZ, Preliminary Development Plan
2799-RZ, Development Plan #3017-88, and Tentative Map for
Subdivision 7146 (Perma-Bilt Homes/Carol Papetti) in the
Walnut Creek Area.
This being the time heretofore noticed by the Clerk of the Board
of Supervisors for hearing on the recommendation of the Contra Costa
County Planning Commission on the request of Perma-Bilt Homes to amend
the County General Plan from Single Family Residential Very-Low
Density to Senior Citizen: Congregate Care ( 4-86-CO) , and the request
by Perma-Bilt Homes (applicant) and Carol Papetti (owner) to rezone
6. 26 acres of land from General Agricultural District (A-2) to Planned
Unit District (P-1) and Preliminary Development Plan approval
( 2799-RZ) , and for approval of Development Plan #3017-88 for a
Congregate Care housing project and for approval of a Tentative Map
for 196 condominium units of a congregate care housing project on 6. 26
acres; and to consider appeal by Perma-Bilt Homes on the decision of
the Contra Costa County Planning Commission on applications
Development Plan #3017-88 and Subdivision ,7146 in the Walnut Creek
area; and
Karl Wandry, Community Development Department, presented the
staff report on the matter before the Board. He described the project
site and location. He commented on the recommendation of the Planning
Commission for denial of the project as a whole, and on their reasons
for their recommendation.
The public hearing was opened and the following people appeared
to speak:
John Wyro, 1660 Olympic Boulevard, Walnut Creek, representing
Perma-Bilt Homes, described the project and commented on issues
including visual impacts, traffic impacts, land use, impacts versus
benefits of the project, and requested approval of the project.
Marge Kimmerer, Associate Planner with the City of Walnut Creek
addressed the appropriateness of the land use in the proposed
location, commenting on the inconsistency of the proposed project with
the City of Walnut Creek' s General Plan designation and Specific Plan
#6 for this location. She commented on the intent of the General and
Specific Plans for the City of Walnut Creek. Ms. Kimmerer commented
on issues including density, the amendment of the City of Walnut Creek
General Plan and Specific Plan, traffic problems in the area, and
expressed the City' s preference to have six single family homes on
this site consistent with the surrounding neighborhood and the
proposed rezoning study that is currently being conducted by the
County.
Evelyn Munn, Mayor, City of Walnut Creek, commented on the draft
copy of the Walnut Creek General Plan that is going through the review
process with the City' s Planning Commission. She commented that if
this proposal is approved it will make it more difficult for the City
to deny the request by Dr. Kronick for a medical facility on the

property adjacent to this request. Mayor Munn commented on issues
including traffic impacts, and efforts by the City of� Walnut Creek
relative to Senior housing.
Chris Satterthwaite, 1032 Choctau Ct. , Walnut Creek, member of
the Walnut Creek Planning Commission, commented on Shell Ridge and
open space, and spoke in support of the Contra Costa County Planning
Commission recommendation for denial. He commented on issues including
the proposed John Muir expansion, the status of housing for seniors in
Contra Costa County, and allowing the City of Walnut Creek to control
their own destiny in this area as it is in the sphere of influence of
the City of Walnut Creek.
The following persons appeared in support of the proposed
project:
Jim Henderson, 5320 Olive Drive, Concord.
Barbara M. Thompson, Chairman, Housing Committee, Advisory
Council on Aging in Contra Costa County.
Jean Zwickel, 2150 Goff Avenue, Pittsburg, member of the Social
Action Committee of Mt. Diablo Unitarian Universalist Church.
Lilyan Thomas, 1574 Hoytt Drive, Concord, presented a petition in
support of the project.
C. Jay Hawkins, 400 Arbol Via, Walnut Creek.
Ernestine Outlin, 2940 Gilma Drive, Richmond.
Jane H. Reed, 1717 Carmel, Walnut Creek.
Ralph Copperman, 3 Penrith Walk, Pleasant Hill, member of Housing
Committee for County of Contra Costa and Grey Panthers of Eastern and
Central Contra Costa County.
Don Anderson, no address given, working with Jerry Loving on Dr.
Kronick' s application before Planning Commission.
The following persons appeared in opposition to the project:
Ed Parks, 160 Brodia Way, Walnut Creek, representing the La Casa
Via Neighborhood Association, presented a petition in opposition to
the project approval.
Nancy Wallace, 1440 Corvey Court, Walnut Creek, representing the
La Casa Via Neighborhood Association.
Ron Armijo, 1420 Corvey Court, Walnut Creek, gave a slide
presentation on the project and the area.

Phyllis Roff, 2893 San Carlos Drive, Walnut Creek.

San S. Yuan, 1520 Sorrel Ct. , Walnut Creek.
Norma Pecci, 38 Terra Verde, Walnut Creek, presented photographs
of the neighborhood to illustrate the rural quality.
Nelson Tsui, 667 La Casa Via, Walnut Creek.
Supervisor Schroder advised the Board and people present that
there were 26 forms and a letter from Hulet Hornbeck Land Negotiator
Co. submitted in favor of the proposal.
Mr. Wyro spoke in rebuttal.
The public hearing was closed.

Supervisor Schroder advised that this was within his District and
commented on issues including the traffic question and that with or
without this project traffic is a problem. He commented on various
recent approvals by the Board for senior housing in Contra Costa
County. He expressed concern relative to the location for this
particular project. He also commented on the changing character of the
area from rural to semi-rural or suburban, and the intrusion of a
project of this magnitude in this area.
Supervisor Schroder moved agreement with the Planning Commission
decision for denial of the project.
Supervisor Torlakson seconded the motion commenting on his
concern for the time and location of this project, the project being
in the sphere of influence of the City of Walnut Creek, and working
with the Local Agency Formation Commission (LAFCO) , the City of Walnut
Creek and the County to resolve some of the pockets of land in the
unincorporated area relative to phasing in annexation.
Supervisor Fanden expressed support for the project, commenting
on issues including the need for this type of congregate housing for
senior citizens, and the compatibility of this type of housing with
residential neighborhoods.
On the motion before the Board, the vote was as follows:
AYES: Supervisors Torlakson and Schroder
NOES: Supervisors Powers, Fanden and McPeak
ABSENT: None
ABSTAIN: None
The motion failed.
Supervisor Powers moved to approve the project with a second by
Supervisor Fanden.
The Board discussed the matter.
Supervisor McPeak addressed the need for senior housing in the
County of Contra Costa, commenting that senior housing belongs in
residential areas and near medical facilities and the appropriateness
of this location for this project.
Supervisor Powers expressed agreement with the comments of
Supervisor Fanden and Supervisor McPeak and he expressed support for
approval of the project.
Supervisor McPeak commented on information provided by the
developer relative to traffic impacts and requested a referral to the
Community Development Department for a report to the Board on this
matter to determine how the impacts can be addressed and mitigated.
She requested the maker of the motion to incorporate this referral.
Supervisor Powers agreed to incorporate the referral.
Karl Wandry, Community Development Department, requested
clarification from the Board prior to the vote that the Board, if
approving the project, would declare its intent to approve the project
and Community Development would return on December 13 , 1988 with the
appropriate documentation for the Board' s consideration. He also
requested clarification on item 4 of the General Plan Amendment being
included or excluded from the final approval, as the inclusion would
preclude the consideration for approval of the Kronick project.
Supervisor Powers indicated it was not his intention to preclude
the Kronick project as he had not seen the project at this time.
IT IS BY THE BOARD ORDERED that the Board DECLARES ITS INTENT to
approve the request of Perma-Bilt Homes to amend the County General
Plan ( 4-86-CO) as amended, rezoning application 2799-RZ, Development
Plan #3017-88 and Tentative Subdivision Map 7146 in the Walnut Creek
area; and the Community Development Department is DIRECTED to prepare
the appropriate documentation including Supervisor McPeak' s above
requested report for Board consideration on December 13 , 1988 at 2: 00
p.m.
