SUBJECT: Appeal filed by the Public Works Department of the approval of
Development Plan #3080-87, Hofmann Company (Applicant and (Owner) .
.SPECIFIC REQUEST S) OR RECOMMENDATIONS(S) & BACKGROUND AND JUSTIFICATION
RECOMMENDATIONS
1. Accept the environmental documentation as adequate.
2. Deny the appeal of the Public Works Department and sustain the
decision of the East County Regional Planning Commission to
.approve Development Plan #3080-87 with conditions attached
hereto.
BACKGROUND/REASONS FOR RECOMMENDATIONS
This application is an amendment of the Final Development Plan for
the Discovery Bay shopping center. The shopping center contains 12
acres of land and is located at the northwest corner of Discovery
Bay Boulevard and Riverview Road in the Discovery Bay area.
The applicant is proposing a total of 84,000 square feet of
commercial area in seven buildings. A child care facility is
included in the plans for the redesigned center. There is adequate
parking for the center (396 spaces proposed - 340 spaces required) .
The East County Regional Planning Commission had numerous hearings
on the application with most of the concern revolving around the
width that Discovery Bay Boulevard should have in front of the
shopping center. The original recommendation was to widen
Discovery Bay Boulevard from 40 feet to 64 feet curb to curb width
from Riverlake Road to Sand Point.
The East County Regional Planning Commission approved the project
on March 28, 1988. On April 7, 1988, the applicant requested
reconsideration of the conditions of approval that required the
widening of Discovery Bay Boulevard from 40 to 64 feet. The
applicant contracted for a traffic analysis focusing on the
Discovery Bay Boulevard frontage of the project.
After several continuances of the reconsideration hearing, the
applicant submitted the traffic analysis. The report was received `
on July 1, 1988. The applicant requested one further delay of the
reconsideration request on July 11, 1988. On August 8, 1988, the
East County Regional Planning Commission closed the hearing and set
August 22, 1988 for decision.
After review of the traffic Analysis the Public works Department
had revised their recommendation to requiring a four foot widening
of Discovery Bay Boulevard from 40 to 44 feet curb to curb. This
widening allows for adequate width for a median, a 16 foot minimum
standard lane and shoulder area for vehicular clearance and bicycle
traffic.
On August 22, 1988, the East County Regional Planning Commission
granted the reconsideration request and approved Development Plan
#3080-87 with a revised condition allowing Discovery Bay Boulevard
to remain 40 feet wide curb to curb with the addition of left turn
channelization.
On August 31, 1988, the County Public Works Department appealed
this decision requesting that Discovery Bay Boulevard be widened to
44 feet curb to curb.
The specific condition of approval involved in this appeal is
Condition 8. , C. Condition 8.C. #''s approved by the East County

The Public Works Department requests that it be amendei d to read:

Remove and replace the existing frontage improvements on the
eastside of Discovery Bay Boulevard which would be affected. "

The Board of Supervisors on November 8, 1988 closed the hearing
on the above matter and deferred decision on the appeal to this date.
Supervisor Torlakson commented that he had taken a tour of the
site with representatives of the Sand Bay Isle Homeowners and the
Hofmann Company. He requested County Counsel and Public Works to
comment on the bicycle path as an alternative and on the landscaping
and screening. He also requested clarification on the flooding
potential on this site.
Karl Wandry, Community Development Department, responded that
Discovery Bay is exempt from the FEMA program because of the type of
levee that was built at the time it was developed. He commented on
the flatness of the area.
Supervisor Torlakson requested comment from the Hofmann Company
on their willingness to work out with the Zoning Administrator the
details of the landscaping and separation buffering plan between the
shopping center area and the nearby residential area, and he
questioned whether there was a need for a sound wall.
David Lennon, representing. the Hofmann Company, responded to
Supervisor Torlakson' s concerns including the protection of the
shopping center area by levees, concurrence of the Homeowners
Association relative to the landscaping of the area between the two
projects. He presented a landscaping plan which they 'intend to review
with the Community Development Department after this meeting.
Supervisor Torlakson requested clarification of the memo
presented by County Counsel relative to the appeal dated November 29,
1988.
Victor Westman, County Counsel, responded to Supervisor
Torlakson' s request.
Supervisor Torlakson moved approval of the final plan with the
stipulations that the Zoning Administrator investigate further the
issue of noise impact on the adjoining residential areas and review
the question of a sound wall versus heavy landscape ,planning that
could provide both the noise and visual buffer between this project
and the proposed projects in the area, and that the bicycle path would
be located on the shopping center side of the Discovery Bay Boulevard
with the appropriate posting and maintenance requirements being
established including the possibility of a maintenance district being
set up to maintain that stretch of bicycle path appropriately, and he
also moved to deny, the appeal of Public Works Department.

CONDITIONS OF APPROVAL FOR DEVELOPMENT PLAN 3080-87
1. This approval is based on the Development Plan received by the Community
Development Department dated November 23, 1987 which consists of the
following items:
A. Site Plan (Sheet 1) .
B. Building Elevations (Sheets 2 and 3) .
C. Sign Plan (Sheet 4) .
D. Landscape Plan (Sheet 5) .
All items in the following conditions which state "per plan(s)" refer the
aforementioned item(s) of this Development Plan.
2. Prior to issuance of a building permit, elevations and architectural design
of the proposed buildings and structures shall be subject to final review
and approval by the County Zoning Administrator. The type and color of
exterior materials for the roof and walls of all structures shall be
stated.
3. The roofs and exterior walls shall be free of all objects: e.g. , TV
aerials, air conditioning/heating units, water of electric meters, etc. , or
shall be screened from view.
4. Prior to the issuance of a Building Permit, the applicant shall submit
revised site and landscape and irrigation plans subject to review and
approval by the Zoning Administrator for the southwestern portion of the
project focussing on the realignment of Building 6.
5. Sign criteria shall meet the following stipulations:
A. Satellite signs are approved per plans, any change shall require
review and approval by the Zoning Administrator.
B. Major tenant signs shall be subject to review and approval by the
County Zoning Administrator.
C. The center sign shall be redesigned to reflect an elevation of 12 to
15 feet and shall be free of lettering. The shopping center name
shall be displayed on monument signs located at the shopping center's
entry/exit point on Discovery Bay Blvd. These signs may be
illuminated by ground mounted lights. Both the center sign and the
monument signs shall be subject to review and approval of the Zoning
Administrator prior to construction.
D. One sign per tenant shall be allowed.
6. Drive-through operations shall be prohibited from Building 7.

7. The child care facility (Building 6) shall adhere with State requirements.
8. The applicant shall comply with the following road and drainage
requirements:
A. Unless exceptions are specifically granted, this development shall
conform to the requirements of Division 914 (Drainage) of the
Subdivision Ordinance.
B. Restrict access along Discovery Bay Blvd. , Sand Point and Riverlake
Road with the exception of the access points shown on the applicants
site plan.
C. Provide left turn channelization along the Discovery Bay Boulevard
frontage of this property, subject to the review of the Public Works
Department, Road Engineering Division and review and approval of the
County Zoning Administrator.
D. Submit improvement plans prepared by a registered civil engineer to
the Public Works Department, Engineering Services Division, for
review; pay the inspection, plan review and applicable lighting fees.
These plans shall include any necessary traffic signage and striping
plans including locations of driveways for review by the County
Traffic Engineer. The improvement plans shall be submitted to the
Public Works Department, Engineering Services Division, prior to the
issuance of any building permit. The review of improvement plans and
payment of all fees shall be completed prior to the clearance of any
building for final inspection by the Public Works Department. If
final inspection is requested prior to construction of improvements,
the applicant shall execute a road improvement agreement with Contra
Costa County and post bonds required by the agreement to guarantee
completion of the work.
E. Comply with the requirements of the Bridge/Thoroughfare Fee Ordinances
for the Discovery Bay as adopted by the Board of Supervisors.
F. Prevent storm drainage, originating on the property and conveyed in a
concentrated manner, from drainage across the sidewalks and driveways.
G. Furnish proof to the Public Works Department, Engineering Services
Division, of the acquisition of all necessary rights of entry, permits
and/or easements for the construction of off-site, temporary or
permanent, road and drainage improvements.
H. Install all new utility distribution services underground.

9. Prior to issuance of a Building Permit, final landscape and irrigation
plans - shall be submitted for review and approval by the County Zoning
Administrator. These plans shall include:
A) The placing of Lombardy Poplars along the western property line at 32
foot 'intervals, and thus be centered in every fourth wrought iron
fence section.
10. Prior to occupancy the landscaping shall be installed.
11. A bicycle path shall be located on the westside of Discovery Bay Boulevard-,
maintenance of the pathway shall be subject to review and approval of the
Zoning Administrator with consideration given the establishing a
maintenance district.
