Giese, Contra Director of Building Inspection Costa DATE: November 15, 1988 V�JICI SUBJECT: INTRODUCE ORDINANCE ON CERTAIN BUILDING PERMIT FEE AND OTHER PROCEDURAL CHANGES SPECIFIC REQUEST(S) OR RECOMMENDATION(S) & BACKGROUND AND JUSTIFICATION RECOMMENDATION• Introduce ordinance on certain Building Permit Fee and Other Procedural Changes, waive first reading, and set December 6 , 1988 at 11: 00 a.m. for adoption. BACKGROUND: By companion ordinance proposed to be adopted together with this ordinance, the Building Inspection Department recommends that Building Inspection Department fees be increased. The County Counsel recommends that actual fee amounts not be included in the County' s Ordinance Code, so that the Code will not have to be amended each time a fee amount is changed. The County Counsel recommends that this opportunity be taken to amend the Ordinance Code to remove references to individual fee amounts for most Building Inspection Department fees. The attached ordinance will accomplish this amendment to the County Ordinance Code. The attached ordinance also makes other changes to the Code recommended by the Building Inspection Department; specifically, it disallows the practice of deferring payment of building permit fees. This practice is already informally administratively disapproved by the Department. This .ordinance is intended to be adopted on the same day the ordinance increasing fees is adopted. PHIL BATCHELOR, CLERK OF THE BOARD OF County Counsel SUPERVISORS AND COUNTY ADMINISTRATOR M382/7-83 BY ,DEPUTY ORDINANCE NO. 88- (Certain Building Permit Fee and other Procedural Changes ) The Contra Costa County Board of Supervisors ordains as follows (omitting the parenthetical footnotes from the official text of the enacted or amended provisions of the County Ordinance Code) : SECTION I. SUMMARY. This ordinance amends Title 7 of the County Ordinance Code to disallow deferred payment of various building permit fees, and to delete references to certain specific amounts of fees assessed pursuant to Title 7 . SECTION II. Section 74-3 . 309 of the County Ordinance Code is amended, to remove provisions governing how building permit fees are determined, which provisions are to be simultaneously re- enacted in a companion ordinance covering most County ordinance! Code Title 7 fees, to read: 74-3 . 309 UBC Section 304, fees. Uniform Building Code Section 304 is amended to read: "Building permit and other fees shall be as set forth in ordinances adopted by the Board of Supervisors . " (Ords . 88- § 2 , 87-55 § 7 , 80-76 § 1 , 80-14 § 7 , 76-15 § 3 . ) SECTION III. Chapter 76-10 of the County Ordinance Code is amended in its entirety, to disallow deferred payment of permit fees, and to delete references to individual permit fee amounts from the County Ordinance Code, to read: CHAPTER 76-10 FEES 76-10 .002 Payment. Subject to the . provisions of Chapter 72- 6, any fee(s ) required for work subject to Division 76 shall be paid by the applicant before any electrical work requiring a permit is started and before the permit is issued. (Ords . 88- § 3 , 82-23 § 2 , 79-67 , 76-24 . ) 76-10 . 004 Permit Fees . Electrical permit and other fees shall be as set forth in ordinances adopted by the Board of Supervisors. (Ord. 88- § 3; See also Ords. 82-23, 80-28, 79-67 , 76-24 . ) 76-10 . 006 Uncompleted Work. If electrical work is left incomplete, the person completing the work shall obtain a new permit. (Ords . 88- 5 3, 82-23 § 2 , 79-67 , 76-24 . ) SECTION IV. Article 78-1. 7 of the County ordinance Code is amended in its entirety, to disallow deferred payment of permit fees , and to delete references to individual permit fee amounts ,from the County Ordinance Code, to read: Article 78-1 . 7 Fees 78-1 . 701 Payment. Subject to the provisions of Chapter 72- 6, any fee(s ) required for work subject to Division 78 shall be paid by the applicant before any work requiring a permit is started and before the permit is issued. (Ords . 88- § 4 , 74-29 . ) ORDINANCE NO. 88- 78-1 . 703 Double fees for delayed permit. (a ) A person who start's any work for which a permit is required under this division without first having obtained a permit therefor shall , if later issued a permit for such work, pay double the permit fee otherwise fixed; however, this provision does not apply to emergency work, if the building inspector determines that such work was urgently necessary and that it was not practicable to obtain a permit therefor before starting the work. In all such cases , a permit must be obtained as soon as it is practicable to do so, and if there is an unreasonable delay in obtaining the permit, a double fee shall be charged. (b) For the purpose of this section a sanitary plumbing outlet on or to which a plumbing fixture or appliance may be set or attached is a fixture. Fees for reconnection and retest of existing plumbing systems in relocated buildings shall be based on the number of plumbing fixtures, gas systems, water heaters, etc. , involved. (Ords . 88- § 4 , 74-29 . ) 78-1 . 705 Permit Fees . Plumbing permit and other fees shall be as set forth in ordinances adopted by the Board of Supervisors . (Ord. 88- § 4 ; See also Ords. 80-76, 80-29 , 76-23, 76-15. ) SECTION V. Article 710-1. 3 of the County Ordinance Code is amended in its entirety, to disallow deferred payment of permit fees, to delete redundant provisions, and to delete references to individual fee amounts from the County Ordinance Code, to read: Article 710-1 . 3 Fees 710-1 . 301 Payment. Subject to the provisions of Chapter 72- 6, any fee(s ) required for work subject to Division 710 shall be paid by the applicant before any work requiring a permit is started and the permit is issued. (Ords . 88- § 5, 74-31. ) 710-1 . 303 Double fees for delayed permit. A person who starts any work for which a.' permit is required hereunder without first having obtained a permit therefor shall , if later issued a permit for such work, pay double the permit fee otherwise fixed; however, this provision does not apply to emergency work, if the building inspector determines that such work was urgently necessary and that it was not practicable to obtain a permit before starting the work. In all such cases a permit must be obtained as soon as it is practicable to do so, and if there is an unreasonable delay in obtaining the permit, a double fee shall be charged. (Ords . 88- § 5, 74-31. ) 710-1 . 305 Permit Fees . Mechanical permit and other fees shall be as set forth in ordinances adopted by the Board of Supervisors. (Ord. 88- § 5; See also Ords. 80-76, 80-28, 76-29 , 76-23, 76- 15 . ) SECTION VI . INTENT. By adopting this ordinance, the Board intends, to the extent practicable, to remove references of specific Title 7 fee amounts from the County Ordinance Code. By companion Ordinance No. 88- , the Board establishes revised and increased Ordinance Code Title 7 fees. Notwithstanding any other provision of this ordinance, it is the intent of the Board that this ordinance shall become operative simultaneously with Ordinance No . 88- and if Ordinance No . 88- or any fee ORDINANCE NO. 88- -2- established pursuant thereto fails to become operative, or is delayed in becoming operative, corresponding fees repealed by this ordinance shall remain in, full force and effect until new fees are established and .operative. SECTION VII. EFFECTIVE AND OPERATIVE DATES. This ordinance becomes effective 30 days after passage, operative 60 days after passage, and within 15 days after passage shall be published once with the names of the supervisors voting for and against it in the Contra Costa Times , a newspaper published in this County.
