Amend Board Order of April 26, 1988 related to approval of 1988/89 County Justice System Subvention Program and related contracts, as follows: a. Increase the District Attorney's PERFORMANCE OF AB 3121 FUNCTIONS project from $253,334 to $288,468 by allocating $35,134 of 1987/88 carryover Subvention Funds to that project. b. Increase the Criminal Justice Agency's PLANNING, COORDINATION, EVALUATION AND ADMINISTRATION project from $77,468 to $106,113 by allocating $28,645 of 1987/88 carryover Subvention Funds to that ', project and authorize the County Administrator, or his designee., to execute an amended contract on behalf of the County with the Criminal Justice Agency. 2. Approve required appropriation and revenue adjustments (AP00 5104 and RA00 5104). FINANCIAL IMPACT: Fiscal year 1987/88 Subvention Funds (commonly referred to as AB 90) are available for expenditure through June 30; 1989. Use of these State. funds as recommended for both the District Attorney and. Criminal Justice Agency projects ' would support activities that otherwise would require County General Funds.. Their use for various tasks related. to planning the new West County detention facility, Proposition 52. correctional facilities planning, tasks related to the.. Marsh Creek and Martinez detention facilities, and initial planning on utilization of Proposition 86 jail bond funds approved November 8', 1988, also contribute to the required. County match for those State funds. REASONS FOR RECOM1ENDATION/BACKGROUND: On April 26, 1988, your Board took various actions related to approval of project amounts and contracts for the 1988/89 County Justice System Subvention Program (formerly AB 90). The requested actions are consistent with the County Justice System Subvention Program Advisory Group policy and practice. This project permits the District Attorney to prosecute Juvenile Delinquency cases pursuant to Welfare and Institutions Code 602. This prosecution is mandated by State law and Subvention funds are the only funds available to the County to cover the cost of this mandate. The additional carryover funds for this fiscal year will enable the District Attorney to maintain timely prosecution efforts on such cases without creating unacceptable delays and backlog. 2. The Criminal Justice Agency has continued to do much of the required planning and management of Propositions 2, 16, and 52 within the County which provide funds for the construction of County correctional facilities. Work is currently underway, as you know, on the West County Justice Center, various upgrades of the Marsh Creek detention facility and the upgrade of the medical and mental health facilities available within the Martinez Detention Facility. With the passage of Proposition 86 on November 8 (County Correctional Facility Capital Expenditure and Youth Facility Bond Act of 1988), the County must begin to plan for the next bond issue for both adult and youth facilities under that measure. That measure provides five hundred million dollars ($500,000,000) statewide for general obligation bonds. The Legislature will determine the allocation formula to counties, with the State agency being the State Board of Corrections. These funds will permit the planning to begin to fulfill whatever State requirements are adopted so that this County can receive its fair share of those funds based upon its needs. CONSEQUENCES OF NEGATIVE ACTION: These State funds must be utilized by June 30, 1989. If not used, they revert to the State.
