SUBJECT: Legislation to Exempt Highway User
Fees from the Gann Limit
SPECIFIC REQUEST(S) OR RECOMMENDATION(S) & BACKGROUND AND JUSTIFICATION
RECOMMENDATION•
Acknowledge receipt of the report of the County Administrator on
Senate Constitutional Amendment 13 , which would have placed on
the November 8 ballot a measure asking that the Constitution be
amended to declare that the revenue derived from the State tax on
motor vehicle fuel which exceeds 9 cents per gallon, the uses of
which are already restricted by the Constitution, be deemed to be
user fees rather than taxes, and that the State' s Gann Limit not
be adjusted as a result of this determination.
BACKGROUND:
On August 2, 1988, on the recommendation of the Director of
Community Development, the Board of Supervisors voted to support
SCA 13 . This measure would have exempted a portion of the State
tax on gasoline from the State' s Gann Limit by declaring it to be
a user fee rather than a tax. This was considered essential
because if the State ran up against its Gann Limit it might not
be able to raise enough State revenue to match federal
transportation dollars.
SCA 13, which had passed the Senate in an entirely different form
on August 20, 1987, was amended in the Assembly Revenue and
Taxation Committee on May 24, 1988 and June 28, 1988, and passed
that Committee on August 2, 1988 by a vote of 12: 3 . The bill
passed the Assembly Elections, Reapportionment and Constitutional
Amendments Committee on August 2, 1988 by a vote 'of 7 : 1. The
bill was referred to the Assembly Transportation Committee where
it died at the end of the Session.
