RECONFIENDATIONS
1. Request the County Administrator to prepare a letter for the
Chairman to sign addressed to all three of the Boards of
Realtors in Contra Costa County as well as the Building
Industry Association reminding these organizations of the
provisions of the ordinance code dealing with signs which
obstruct the right-of-way and asking for their cooperation
in observing the law. In addition, request these
organizations not to place signs on private property without
the permission of the owner.
2 . Request the County Administrator to send copies of the above
letters to each city in the County suggesting that they take
similar action in order to control the proliferation of
signs along roadways in the County.
3 . Remove this item as a referral to our Committee.
BACKGROUND:
On July 12, 1988, as a part of considering our Committee' s report
on the nuisance ordinance, Supervisor Schroder also noted
problems which have been created by the proliferation of signs
along roadways in the County, sometimes in the right-of-way and
sometimes on private property. In researching this matter,
County Counsel noted that the County ordinance code already
prohibits encroaching on any County right-of-way by erecting or
maintaining and posting a sign on, over, or ' under the
right-of-way. The Ordinance Code also authorizes the Director of
Public Works to immediately remove an encroachment which is an
advertising sign.
On October 24, 1988, our Committee met with County Counsel and
Maurice Mitchell from the Public Works Department. Mr. Mitchell
noted that his department does respond to complaints of signs
placed within the right-of-way, but does not have the staff to
routinely patrol county roads looking for such signs. A
representative from the Alamo Improvement Association was present
and supplied our Committee with pictures of several signs in the

property by developers or real estate brokers.
Our Committee is recommending that the Chairman send a letter to
the three Boards of Realtors and the BIA reminding them that it
is illegal to place such signs in the right-of-way and asking for
their cooperation in advising their members not to violate the
law and also not to place such signs on private property without
the permission of the property owner.
We are also suggesting that copies of these letters be sent to
each city in the county asking that they take similar action.
