DOARD OF SUPERVISORS 1--03 FROM: Mark Finucane , Health Services Director Oxtra Gcsta DATE: October 4 , 1988 courty SUBJECT: Ordinance 88-26 Impact SPECIFIC REQUEST(S) OR RECOMMENDATION(S) & BACKGROUND AND JUSTIFICATION RECOMMENDED ACTION : Accept follow-up report from Health Services Director in response to Supervisor McPeak ' s request of June 28 , 1988 regarding the impact of Ordinance 88-26 . FINANCIAL IMPACT : None BACKGROUND : On July 29 , 1988 the Health Services Director submitted a report to the Board of Supervisors on the impact of Ordinance 88-26 . The Environmental Health Division indi - cated in the report that while all 16 facilities subject to Ordinance 88-26 are in compliance , three of them may not meet the January 1 , 1989 TPCA deadline for deinventory . Environmental Health Division staff reviewed the status of the ponds at I .T . Corporation , Chevron , and Stauffer ( Martinez ) with Regional Water Quality Control Board ( RWQCB ) staff on September 28 and 29 , 1988 . This report summarizes the present status of the ponds and RWQCB ' s anticipated compliance strategy . CHEVRON U .S .A. , Richmond In July , 1988 RWQCB issued a comprehensive order to Chevron , specifying timeframes for. complete closure of all Chevron Ortho and Chevron U .S .A . ponds over the next ten years . Included in this order is the Chevron U .S . A. Pollard pond , which will not be deinventoried by January 1 , 1989 . RWQCB plans to check closure progress monthly for each pond . STAUFFER , Martinez Stauffer submitted a closure plan at the end of June , 1988 . The plan is under review. A Cease and Desist Order spe- cifying timeframes for closure is possible . RWQCB feels that Stauffer is presently actively pursuing closure . It is felt that the delay in meeting the January 1 , 1989 deadline is more than offset by the superior nature of the proposed closure . i I . T . CORPORATION , Martinez The ponds at Baker and Vine Hill will not be deinventoried by January 1 , 1989 . The RWQCB will issue a new order shortly after January 1 , specifying timeframes for . compliance . A closure plan has not been approved by EPA yet . The emphasis of RWQCB ' s order will be on adequate ultimate closure under RCRA. Once a closure plan has been approved ; RWQCB will be able to determine whether closure is being "actively pursued" . If not , enforcement action would follow. ! I .T . has applied for a variance from Ordinance 88-26 . Drafter terms of the variance have been circulated to the agencies for review. CONCLUSION : RWQCB plans to issue orders with updated timeframes based on closure plans for those facilities with ponds that will not be deinventoried by January 1 , 1989 . Enforcement action is planned for those facilities that are not "actively pur- suing" closure . RWQCB is placing a premium on " superior closure" irather than previously mandated deadlines . -2- i I I i I i I
