FINANCIAL IMPACT: The Public Works Director recommends that the project be funded initially using general fund monies. County Counsel has initiated legal action against the developer and the bonding company to recover all of the County' s costs associated with the project. After the construction is completed and all of the costs are known, County Counsel can conclude litigation and the general fund will be reimbursed using the funds collected from the developer and the bonding company. III. REASONS FOR RECOMMENDATION/BACKGROUND: On August 30 , 1988 , the Board approved the plans and specifications for the subdivision 5066 Deficiency Correction project and advertised for bids to be opened on September 22, 1988 . There were no bids received for this project. The Public Works Director has recommended that the project be readvertised and has filed with the Board of Supervisors revised Plans and Specifications for the Subdivision 5066 Deficiency Correction Project. The general prevailing rates of wages, which shall be the minimum rates paid on this project, have been filed with the Clerk of the Board and copies will be made available to any interested party upon request. The project has been determined to be in compliance with the General Plan. This project is exempt from CEQA requirements as a Class 1C Categorical Exemption because all of the work will be performed on existing roadway and drainage improvements. IV. CONSEQUENCES OF NEGATIVE ACTION A portion of the drainage system within Subdivision 5066 carries water that originates on County maintained roadways outside of the Subdivision' s boundaries. If the deficiencies are not corrected, the Subdivision 5066 improvements, (which are located within easements that have been offered to the County) cannot be accepted for maintenance. bo:El.Sob3 .t8
