September 26, 1988 C Status Report on SUBJECT: provisional Appointments SPECIFIC REQUEST(S) OR RECOMMENDATION(S) IN BACKGROUND AND JUSTIFICATION RECOMMENDATIONS: 1. Acknowledge the report of the Director of Personnel on Provisional Appointments for the period March 1, 1988--August 31, 1988. 2. Request the Director of Personnel to make a further report to our Committee December 12, 1988 on the status of provisional appointments for the period March 1, 1988--November 30, 1988 . 3 . Leave this matter on referral to our Committee. BACKGROUND: On March 29, 1988, the Board of Supervisors requested the Director of Personnel to make a report to our Committee on the. status of provisional appointments that have been made in the County. Provisional appointments are those where an individual is appointed to a position pending an examination. Being given such an appointment gives an individual a clear advantage before an oral board. Since a department head makes a provisional appointment without the benefit of an examination process, there is the possibility that such appointments can circumvent our Affirmative Action goals. As a result, we have been concerned to see how often this process is used and what the final results of the appointment process are. On September 26, 1988, our Committee met with staff from the Personnel Department to review the provisional appointments which have been made since March 1, 1988. As the attached report indicates, there have been four provisional appointments made since March 1, 1988 . Three of these provisional appointments have been terminated since March 1, 1988 . In the three instances where provisional appointments were made, the following actions were taken: 1 . One Hispanic male who was provisionally appointed to a Health Services Administrator position was given a temporary appointment as a Health Services Administrator effective May 1, 1988 . One white male who was provisionally appointed as Emergency Services Director was permanently appointed to an exempt position as Emergency Services Director effective July 1, 1988 . 3 . One white female who was provisionally appointed to a position as Social Services Program Manager--Project was appointed to a permanent position as Social Services Program Manager--Project effective September 1, 1988. The fourth provisional appointment, and the only one which continues in effect, is the appointment of a white male as Administrator--Municipal Courts. In order to continue to monitor provisional appointments, our Committee recommends that the Board take the above actions.
