Bragdon Contra Director -of Community Development DATE: December 8, 1987 Courty SUBJECT: Hearing on Rezoning Application 2738-RZ to rezone 50.3 acres of ' land located between Live Oak Avenue and Empire Avenue south of Tate Lane in the Oakley area from General Agriculture (A-2) to Planned Unit District (P-1) along with preliminary development plan to subdivide and construct 259 single family residences filed by Bellecci and Associates (Applicants) and Kenneth L. Crockett (Owner) . SPECIFIC REQUEST(S) OR RECOMMENDATIONS(S) & BACKGROUND AND JUSTIFICATION RECOMMENDATIONS 1. Accept the environmental documentation as being adequate. 2. Approve the Rezoning Application 2738-RZ as recommended by the East County Regional Planning Commission. 3. Adopt the East County Regional Planning Commission's findings as set forth in Resolution No. 64-1987 as the determination for these actions with conditions of approval 4: Introduce the ordinance giving effect to the aforesaid rezoning, waive reading and set date for adoption of same. CONTINUED ON ATTACHMENT: YES SIONAMA4 ACTION OF BOARD ON January 26, 1988 APPROVED AS RECOMMENDED OTHER x _ The Board on January 19, 1988 deferred to January 26, 1988 the decision on the rezoning application 2738-RZ. Supervisor Torlakson commented on the proposed conditions of approval before the Board indicating that there had been some changes since the material was prepared and that he would recommend that the total number of lots be changed to 249, and possibly eliminating three lots along the north side to provide more buffering, relocating the eliminated lots in the project in the form of duets. He commented that under condition 4B that instead of a Homeowners Association being responsible for maintaining the fence and the landscaping that it should be a Landscape District Sub-Zone, and in 4G instead of Homeowners Association to have Landscape District Sub-Zone. He explained further changes to the proposed conditions indicated on the attached exhibit A. Supervisor Torlakson moved approval of the project with the proposed amended conditions. Supervisor Schroder clarified that this was to declare intent to approve the project with the amended conditions and findings. The Board discussed the matter. Therefore, IT IS BY THE BOARD ORDERED that the Board DECLARES ITS INTENT to approve recommendations 1, 2, 3 with amended conditions, and as in recommendation 4, Ordinance No. 88-16 is INTRODUCED, reading waived; and the Community Development Department is REQUESTED to prepare the appropriate documentation for Board consideration.
