SUBJECT: Hearing on Rezoning Application 2731-RZ to rezone approximately 10
acres of land fronting on Empire Avenue, 1,100 feet north of the
intersection of Empire Avenue and Laurel Road in the Oakley area from
General Agriculture (A-2) to Planned Unit Development (P-1) along with
a preliminary development plan for 43 residential lots, filed by Joe
L• and Mary D. Cunha (Applicants & Owners) .
SPECIFIC REQUEST(S) OR RECONMEriDATIONS(S) i BACKGROUND AND JUSTIFICATION
RECOMMENDATIONS fir,
1. Accept the environmental documentation as being adequate.
2. Approve the Rezoning Application 2731-RZ as recommended by the
East County Regional Planning Commission.
3. Adopt the_East County Regional Planning Commission's findings
as set forth in Resolution No. 62-1987 as the determinations
for these actions with conditions of approval-

rezoning, waive reading and set date for adoption of same.

The Board on January 19, 1988 deferred to January 26, 1988 the
decision on the rezoning application 2731-RZ.
Supervisor Torlakson commented on the proposed changes in the
conditions of approval, Exhibit A attached, and the addition of a
condition to remove the islands from the cul de sac streets.
Jean Messick, Community Development Department, requested that
the Board declare its intent to approve the rezoning subject to
findings to be brought back for Board consideration.
Therefore, on recommendation of Supervisor Torlakson, IT IS BY
THE BOARD ORDERED that the Board DECLARES ITS INTENT to approve
recommendations 1, 2 and 3 with amended conditions; and as in
recommendation 3 , Ordinance No. 88-14 is INTRODUCED, reading waived, ;
and the Community Development staff is requested to prepare the
appropriate documentation for Board consideration.

2. The total number of units shall not exceed 45. Two additional lots
may be considered in the northeast and northwest portion of the site
near the existing homesites at Bedford Lane.
3. H. The homes adjacent to Bedford Lane shall consist of one-story and
two-story elements with the single-story element adjacent to
Bedford Lane.
