a result of striking a negligently constructed and
maintained ramp in the middle of the block .

1. Date, Place and Circumstances of Occurrence/Transaction
Giving Rise to the Claim:
Claimant is the owner of that real property commonly known as Lot
14, Tract 3035, Filed July 13, 1962, Map Book 88, Page 8, Contra
Costa County Records , Assessor 's Parcel No. 268-481-002, in the
City of Orinda, County of Contra Costa, State of California.
Beginning on or about October 7, 1987 , the City of Orinda and the
County of Contra Costa, acting in concert with Knapp Excavators,
Inc . , and Lawrence W. Hartinger, did trespass upon and create a
nuisance upon Claimant ' s real property described above, by
depositing thereon thousands of cubic yards of soils and
materials in a injurious, illegal, unpermitted and improper
fashion .
On or about October 27 , 1987, security was issued by Lawrence W.
Hartinger to the City of Orinda which Claimant is informed and
believes was for the benefit of persons and entities such as
claimant who would be injured by the operations and concerted
actions referred to above .
2. Indebtedness, Obligation, Injury, Damage and Loss Incurred so
far as it is now known:
Claimant is informed and believes that his property has been
injured and damaged, and that the importation of vast quantities
of fill materials which has been placed on his property in a
negligent, hazardous fashion threatens to cause further damage
not only to Claimant 's property, but potentially to adjoining and
adjacent and other neighborhood properties. In addition to the
damage caused to his property, the trespass that has been
committed on the property, the nuisance that has been made of his
property, claimant is informed and believes that said deposit of
materials may subject Claimant to various liabilities and damages
the form of which are not as yet known.
Claimant believes that his damages exceed $100, 000, and in
addition, Claimant makes claim upon the bonds/security referred
in Item 4 of the Memo, dated October 27 , 1987 , from Robert L.
Wornick, City Engineer, to Wayne Rasmussen, Planning Director.
The name or names of the public employees causing the injury and
damage or loss, so far as is known to date at this time, would
include Wayne Rasmussen, Planning Director; Robert Warnick , City
Engineer; Tom Sinclair, City Manager; Charles Williams, City
Attorney; Gordon Wisler, Grading Engineer; Tom Roberts, Grading
Technician; and other emploYees not presently known.
3 . The Amount Claimed:
Although the total damages sustained by Claimant are contingent
and undetermined at this time, the following is the best
approximation Claimant can now make:
Diminished value of real property: $500, 000. 00
Cost to remove trespass and abate nuisance : $500, 000 . 00
Cost to repair property: $500,000.00
Punitive Damages Against Individual Defendants : $1 , 000, 000.00
Emotional Distress Damages: $500, 000 .00
Attorneys ' Fees and Costs : $500,000 .00
Contingent and Undetermined Bonds and/or Assurances inuring to
