ZONING, OAKLEY AREA

RECOMMENDED ACTION: Initiate General 'Plan Amendment to
change the general plan designation on the Windmill Farms subdivision
to its current status of one-acre minimum, single family residential
zoning.
BACKGROUND INFORMATION: I have received a letter from Anne
C. Way requesting this General Plan Amendment. The basis for this
request as outlined in the letter is as follows:
a The New Oakley General Plan incorrectly identified
Windmill Farms as PUD 3 - 5 density even though this was not the wish
of the property owners. The Windmill Farms subdivision has Covenents,
Conditions & Restrictions in all Deeds that restrict each parcel to
one single family residence. This direct . conflict with deed restric-
tions could cause future legal and enforcement problems for the
Homeowners Association.
® The Windmill Farms subdivision contains one vacant lot
which would be required by the current General Plan to contain a
minimum of three dwelling units. This makes this lot undevelopable
due to an inability to properly buffer the existing neighbors and
reduces both its value and the value of surrounding properties.
