Amendments to County Election Campaign Ordinance
SPECIFIC REQUEST(S) OR RECOMMENDATION(S) & BACKGROUND AND JUSTIFICATION
RECOMMENDATION
Introduce the attached- ordinance which broadens the exemptions
from the limitson campaign contributions to include the receipt
and spending of money for charitable, nonprofit, civic and
educational organizations and purposes, waive reading and fix
January 19, 1988 for adoption.
BACKGROUND
On December 15, 1987 County Counsel presented the attached
ordinance to the Board. The Board referred the ordinance to the
Internal Operations Committee. Our Committee met on this issue-
on January 4, 1988 . The proposed ordinance allows a Board member
to establish a separate controlled committee for the specific
purpose of making contributions to charitable, nonprofit, civic
and educational organizations and purposes. Contributions made
by individuals to such a controlled committee would be exempt
from the limit on campaign contributions.
To the extent that the proposed ordinance gives Board members the
option to set up such a separate committee for the purposes
indicated we believe it is an appropriate amendment to the
County' s Campaign Ordinance.

(Exemption under Election Campaign Ordinance )
Contra Costa County Board of Supervisors ordains as
follows (omit=ting the parenthetical footnotes from the official
text of the enai.-t--,d or amended provisions of the County Ordinance
Code )

PION I . ;:UMP,'iARY . This ordinance amends Division 530 ,
Flection Campaiqn , Chapter 530-2 , Fair Campaigns , Article 530-
2 . 2 . , General , to broaden the terms and applications of the
exemption under the County Ordinance Code , in order to permit
contr.olled committees to raise , receive and spend money for
non-profit , charitable , civic , and educational organizations and
purposes not directly related to a campaign for County office .
SECTION II . Section 530-2 . 214 Exemptions is amended to read:
530-2 . 214 Exemptions . Notwithstanding any other
)ro°:Tision in this chapter , it does not apply to contributions
placed in a controlled committee( s ) of an incumbent of a
County of `ice where ,
( 1 ) that incumbent designates the committee as a
cortlmitl-.tee to collect funds for purposes other than a campaign

or County office .
( 2 ) those funds are not used for any purpose related to
a campaign by that incumbent ; and
( 3 ) those funds are not transferred to or used for any
other (-ommi_ttee controlled by that inc_imbent which raises or
recei',%es or spends money for the purposes relater to a
campaign fo.r a County office .
When a controlled committee of an incumbent of a County
office is designated by the incumbent to collect, and the
committee collects and uses , funds .for the following
purposes , such funds are not collected or used for purposes
of a campaign for. County office , nor related to a campaign by
the incumbent :
( 1 ) donations to charitable and non-profit
organizations ;
( 2 ) memberships in civic organizations ;
( 3 ) education scholarships ;
( 4 ) subscriptions to newspapers ;
( 3 ) reimbursement for meals , transportation , and
accommodations for governmental meetings ;
( 6 ) purchase of space in program inserts for events
benefitting charitable and non-profit organizations ; or
( 7 ) compensation for contract staff_ work of a non-
campaign nature .

SECTION III . EFFECTIVE DATE. This ordinance becomes
effective 30 days after passage , and within 15 days after passage
shall_ be published once with the names of supervisors voting for
