HomeMy WebLinkAboutMINUTES - 01121988 - 2.5 THE BOARD OF SUPERVISORS OF CONTRA COSTA COUNTY, CALIFORNIA 2 . 5 Adopted this Order on _January 12, 1988_, by the following vote: AYES: Supervisors Powers, Fanden, McPeak, Torlakson and Schroder NOES: None ABSENT: None ABSTAIN: None SUBJECT: East Contra Costa Transit Authority-Reimbursement Agreement Bud Murphy, Contra Costa County Flood Control, in responding to a letter from the East Contra Costa Transit Authority, objecting to conditions in a proposed reimbursement agreement for part of the improvements that they constructed when they built their new bus terminal on Wilbur in Antioch, commented that Drainage Area 56 operates under a policy which has an item in it that says under reimbursement agreements, any payments that are not paid within the first forty quarters or ten years are no longer an obligation against the district, and that this is a practice that has been carried forward since the first drainage areas. He commented that the strict application of the current policy would be to have the forty quarter time limit apply and that the staff recommendation is to hold to that policy and that staff report back to Tri Delta that that is the position. Anne Drew, 801 Wilbur, Antioch, Manager representing the Board of Directors of East Contra Costa Transit Authority, requested an exemption for the Transit District from the clause relative to the forty quarters; but advised that the rest of the agreement is satisfactory. Supervisor Torlakson suggested that it would be appropriate to also exempt other taxing agencies from the forty quarters or ten year expiration date reimbursement obligation, and recommended that staff be directed to develop appropriate language and that the Board conceptually agree to the exemption idea which would answer the District' s needs. He moved to conceptually support the idea of other government agencies to not have the forty quarters limit apply, and to request staff to develop the appropriate language and report back to the Board at the earliest opportunity available. Supervisor Powers questioned the Board making a distinction between government agencies and private developers. Supervisor Schroder expressed concern for setting a double standard between the private sector and the public sector. Supervisor McPeak seconded the motion. ' Supervisor Schroder recommended referring to the Internal Operations Committee the issue of the policy of reimbursement. The Board discussed the matter. Victor Westman, County Counsel, suggested a modification of policy whereby until they start to share in the fees, the ten year period does not start to run. Therefore, IT IS BY THE BOARD ORDERED that the request by East Contra Costa Transit Authority for exemption from certain provisions 1 :L o of the proposed reimbursement agreement is REFERRED to the Public Works Director as the Chief Engineer of the Contra Costa County Flood Control and Water Conservation District; he is REQUESTED to develop a revised agreement for consideration by the Board. IT IS FURTHER ORDERED that the issue of the policy on reimbursement is REFERRED to the Internal Operations Committee.
